Duties and Responsibilities include the following. Other duties may be assigned.

  • Responsible for compliance with the Fair Debt Collections Practices Act and consumer privacy laws.
  • Analyze credit and collateral file and make recommendations for the appropriate legal action necessary to collect and/or settle the account.
  • Review personal credit and asset reports to determine the appropriate collection strategy and coordinate such action with an authorized attorney.
  • Research potential legal files, gathering all required documentation to support legal pursuit. Preparing such files with specific attorney instructions on the legal actions required and expectations on recovery.
  • Communicate with attorneys upon referral to direct any additional prosecution of the action and obtain weekly/monthly status updates/reports to assure the legal actions are properly and timely being acted upon.
  • Make appropriate file notation for all correspondence, emails, status reports, or any other event, as they occur.
  • Work and communicate with other internal teams as necessary with questions/concerns regarding potential legal actions or responses to protect the interests of all parties.
  • Reviews all existing and potential legal accounts for correct statute of limitation date to assure actions are completed before the status expires. This includes, but is not limited to, judgment renewals,extensions, and domestications.
  • Communicate directly with consumers and other authorized 3rd parties, including opposing counsel, when necessary.
  • Perform other related duties as assigned.

Qualifications:

To perform this job successfully, this person must be highly organized, with an ability to multi-task, maintain attention to detail, and be able to manage time wisely. The ideal candidate should be able to work with minimal supervision on day-to-day tasks, possess an above average knowledge of the legal process as it relates to the consumer and commercial collection industry. This person should also have in-depth knowledge of real estate transactions, documentation, charged-off loans, and foreclosures. In addition, the candidate should possess excellent interpersonal and communication skills, both verbal and written, and possess proficient computer skills. College education preferred.

Language Ability:

Ability to read and comprehend complex instructions, correspondence, and memos. Ability to write detailed correspondence. Ability to effectively present information in one-on-one and small group situations to customers, clients, and other employees of the organization.

Technical Ability:

Highly proficient in Microsoft Excel, Word, Outlook, and the ability to quickly learn proprietary collection software systems.

Reasoning Ability:

Ability to apply common sense understanding to carry out instructions furnished in written, oral, or diagram form. Ability to deal with complex problems involving several variables and situations.

Education/Experience:

College degree preferred. High school diploma or general education degree (GED) with 2 (two) plus years of related experience in consumer and commercial legal collections.

Specialized Training:

FDCPA and FCRA training
