What are the responsibilities and job description for the Litigation & Employment Counsel position at Instawork?
We’re looking for a self-motivated, intellectually curious, and pragmatic Litigation & Employment Counsel. As the company’s fourth attorney, you’ll manage a dynamic workload with independent initiative and interdepartmental collaboration. You must have demonstrated success managing civil and administrative cases, including insurance matters and regulatory investigations. You should also have a strong background in labor and employment law. Reporting to our Deputy General Counsel, this role expands a small but scrappy Legal team and will be responsible for helping to scale legal functions at a company named one of Forbes’s 25 Next Billion Dollar Startups.
Primary Responsibilities
- Handling and resolving a wide variety of litigation and pre-litigation matters in state and federal courts and administrative forums, especially matters involving worker classification and employment-related claims;
- Managing all aspects of the relationship with relevant outside counsel, including staffing, strategy, budgets, work product, and discovery;
- Working closely with Instawork’s Trust and Safety team, insurance brokers, and insurance carriers;
- Partnering with Human Resources and business partners to evaluate legal risks and provide subject matter expertise on a broad range of employment issues, including wage and hour, recruiting and hiring, training, employee performance management, leaves of absence, disability accommodations, and HR best practices;
- Respond to 3rd party subpoenas for documents and/or witness testimony;
- Help prepare for and mitigate exposure that may create litigation risk in the future;
- Develop, implement, and improve scalable processes for the legal team;
- Other projects based on the needs of a quickly growing international company
Qualifications
- JD and California bar admission in good standing (or barred in NY or IL and qualified for and willing to maintain Registered In-House Counsel status with California State Bar)
- 5 years of legal experience in a law firm and/or in-house
- Detail- and process-oriented mentality
- Mature judgment and decision-making skills
- Ability to translate complex concepts and competing priorities into digestible guidance
- Team mentality and recognition that no task is too small
- Composure managing multiple projects with overlapping deadlines
- Excellent verbal and written communication skills
- Sense of perspective…and humor
- Nice to have: privacy and product counseling experience
For CA based applicants:
- The base salary for this position is $150,000 - $175,000
- This position is eligible for equity in the form of stock options
