Actalent is in search of a well qualified individual who has experience with construction claims and litigation.
**The Official Title for this position is Director of Construction Claims
This position functions as a deputy/legal consultant to the Project Director who oversees the planning, design, and construction of our large infrastructure project. The position is necessary to avoid, mitigate, and resolve construction claims, including bid protests arising from the procurement process.
Duties and responsibilities include:
- Reporting of construction claims to the Executive Director and the FTA’s Project Management Oversight Contractor.
- Advises Administration/Management on matters related to bid protests, construction claims, utilities, third party agreements, and insurance risk management. Participates in top-level management meetings and discussions to develop and execute department directions, goals, and strategies.
- Develops, reviews, evaluates, and updates policies and procedures pertaining to the management of construction claims, third party agreements, and related matters.
- Oversees, manages, directs, and coordinates the overall Construction Claims program.
- Utilizing knowledge of the Hawaii Public Procurement Code, reviews, analyzes, and drafts responses to bid protests.
- Reviews and assists in drafting briefs filed with the Office of Administrative Hearings, DCCA. Coordinates and assists in preparing witnesses for the hearing.
- Interfaces with divisions, including design and construction, to identify escalating issues and disputed change orders that may result in a claim.
- Provides advice and assistance to division staff in drafting correspondence to prevent claims or support in future claims.
- Performs cost and schedule analysis for preparation for mediation or court proceedings; interfaces with appropriate experts to assist with complex and/or technical issues, including schedule and program delays, economic damages, time impact.
- Interfaces with insurance and surety companies (requires understanding of surety and tendering on insurance and surety policies).
- Interfaces with Corporation Counsel and/or outside legal counsel in issues/claims analysis and preparation for mediation, dispute resolution board, request for final determination by the Chief Procurement Office, and court proceedings.
- Oversees, reviews, and assists in drafting all documents to be submitted or filed to above-mentioned dispute venues (mediation, dispute board, etc.); this requires high-level skills to analyze the issues, strategize, and draft the relevant and appropriate documents.
- Manages and coordinates (between divisions and legal counsel) all claims proceedings, including depositions, document review, motions, counter-motions.
- Oversees the forensic review of project documentation for elevated issues/claims.
- Assists relevant divisions in analyzing contract requirements for elevated issues/claims.
- Works collaboratively with other departments to ensure compliance with FTA requirements and notification of potential non-compliance.
Education Preference: Juris doctorate degree and prior experience in construction claims and litigation.
Experience:
- Procurement, contract administration, and/or contract law.
- Minimum of 10 years of relevant experience in litigation, contract administration, or construction claims.
- Complex State and/or Federal court proceedings.
- Managing or supervising staff
Pay and Benefits
The pay range for this position is $52.00 - $88.00/hr.
