SUMMARY:

Primary responsibilities of a Manager, Casualty Claims – Litigation includes the management and oversight of Claims Representatives handling primarily litigated, casualty claims across the United States. Casualty claims include but are not limited to commercial general liability claims, commercial auto claims, trucking claims, excess claims, garage claims and liquor liability claims.

 

RESPONSBILITIES/TASKS:

  1. Supervise and manage Claims Representatives who handle complex, primarily litigated, third-party casualty claims.
  2. Supervise and manage designated coverage issues on litigated casualty claim files and casualty claim files with potential for litigation.
  3. Review and approve coverage determination letters.
  4. Assist in training Claims Representatives in the handling of designated issues involving liability, value, civil procedure and State and Federal law.
  5. Provide guidance to Claims Representatives on their negotiations, mediations, arbitrations and settlement procedures as assigned.
  6. Conduct legal research as necessary on pending suit files and as requested by other departments.
  7. Conduct audits of litigated claim files.
  8. Review company policy forms as needed.
  9. Build supportive, team-orientated environment for the staff through embodying a sense of empowerment, demonstrating positive thinking and establish common goals and interdependence with employees.
  10. Control administrative costs through appropriate staffing, staff training and development and close monitoring of ongoing expense allocations.
  11. Identify and recommend qualified candidates to fill vacancies. Recognize talent and ability and recommend rewards. Implement strategies to retain staff and they support diversity efforts.
  12. Manage performance improvement in accordance with Human Resources guidelines and expectations.
  13. Enforce performance standards according to corporate policy and divisional objectives. Set plans for employee performance improvement and development.
  14. Develop and implement a succession plan for position.
  15. Monitor the quality of work produced within the unit and provide technical assistance to staff.
  16. Approve settlements, reserve changes and subrogation decisions within authorized limits.
  17. Maintain statistics and files on unit performance and prepare periodic reports as required.
  18. Ensure proper controls for litigation management and enforce within the unit.
  19. Establish goals and objectives for unit.
  20. Understand technical aspects of claim file pending in unit.
  21. Conduct ongoing individual and unit trainings.
  22. Perform self-audits on direct reports as prescribed by Corporate Claims.
  23. Must adhere to the company code of ethics.
  24. Other duties as assigned by General Counsel, Sr. Claims Management or Executive Management.
  25. Ability to interact with others in a professional manner.
  26. Attendance.

 

KNOWLEDGE, SKILLS AND ABILITIES REQUIRED TO PERFORM ESSENTIAL FUNCTIONS:

  1. Bachelor’s degree from a 4-year college or university and Jurist Doctorate degree and/or CPCU preferred.
  2. A minimum of 7 years related experience.
  3. Management and supervisory skills in Commercial General Liability insurance policies with leadership abilities.
  4. Superior technical knowledge of federal, state and local statutes regarding claims activity.
  5. Ability to analyze complex coverage submissions and provide assistance.
  6. Ability to prioritize, organize and plan work for self and others.
  7. Excellent customer service skills.
  8. Excellent written and oral communication skills.
  9. Excellent problem-solving ability.
  10. Thorough knowledge of claim procedures, policies, terminology, etc.
  11. Detailed knowledge of Company’s established claims processing procedures.
  12. Computer proficient with Microsoft Office programs, such as Word, Excel and Outlook.
  13. Ability to prioritize, organize and plan work for self and others.
  14. Possess a valid driver’s license and State adjusting license(s) as applicable.
  15. Ensure assigned files are handled in good faith as defined by statute, case-law and corporate standards.
  16. Ability to travel as required.
  17. Sit, stand, walk/ambulatory.
  18. Ability to lift 10 pounds.

This position can be staffed as a remote work-from-home position or in one of our offices (Lansing, MI, Overland Park, KS, Scottsdale, AZ or Westerville, OH).

PAY RANGE:  Actual compensation decision relies on the consideration of internal equity, candidate’s skills and professional experience, geographic location, market, and other potential factors. It is not standard practice for an offer to be at or near the top of the range, and therefore a reasonable estimate for this role is between $92,200 and $154,500.
