Overview

Compensation for this position is base pay ($20.19) plus commission. 

 

Responsible for performing collection activities associated with serious delinquent member accounts, including Visa credit and debit cards, lines of credit, secured loans, personal loans, negative shares to checking, real estate loans, and home equity lines of credit that are involved in legal proceedings. Accounts that are recommended for legal action that can be remedied without legal action will require collection activities to be performed. Works closely with attorneys on all legal accounts: Writ of Replevin, Foreclosures, Judgements, and tribal accounts. Will represent the Credit Union and compile small claims when the Credit Union is the defendant. Also assists Legal Coordinator in filing small claims cases for the Credit Union. Handles all tribal court proceedings and representation. Collects on all judgments, i.e. wage garnishments, bank garnishments and seizure of assets. Coordinates and assists with constable to service members legal paperwork. Handles foreclosures. Ensures that actions are properly documented, and records and files appropriately maintained. Ensures that the Credit Union’s professional image is maintained.

Responsibilities

1. Assumes responsibility for the effective and professional performance of collections' functions.

a. Utilizes effective human relations skills and various forms of persuasion to present a positive Credit Union image in an already negative situation. Calms irate members and answers member questions and complaints relevant to Department functions. Works to minimize losses.

 

b. Assists co-workers and other departments on legal questions and legal related issues.

 

c. Assists the bankruptcy team on any bankruptcy mediation through the DMM portal.

 

d. Has a clear understanding of, and is knowledgeable on all contracts the member has with the Credit Union.

 

e. Reviews delinquent accounts to determine Credit Union’s position and as circumstances dictate directs and assist legal counsel in collection proceedings.

 

f. Utilizes a high level of skip tracing skills. Uses various tools, websites, contacts and other resources to locate collateral and members.g. Works toward prompt recovery of collateral through negotiations with attorney and/or court. h. Directs legal counsel in court complaints and post judgment actions including garnishments, supplemental orders and execution, and small claims.

 

i. Services all Tribal Court proceedings and representation. j. Handles and oversees foreclosure proceedings involving real property. Works with legal counsel to coordinate trustee sales, evictions, and title transfers to the Credit Union. Works with attorney or individually to clear any unresolved title issues on Real Property.

 

k. Follows written off mortgage loans to determine when we have equity.

 

l. Works with Attorney for new letters and forms.

 

m. Sends pre-litigation letters to constable for service on negative accounts. Monitors and follows up with constable for updates and service. n. Monitors all attorney accounts to ensure documents and legal proceedings are filed and followed up by legal counsel in a timely manner.

 

o. Attends court hearings and if needed will testify for America First Credit Union.

 

p. Reviews Attorney Bills for totals and to ensure the accuracy overall.

 

q. Tracks judgments for validity and renewal when needed.

 

r. Performs collections' efforts in accordance with Credit Union policies and procedures and ensures they are legally compliant.

2. Assumes responsibility for the efficient administration of collections' activities.

 

a. Documents all collection actions taken, including telephone conversations, alternative financial arrangements, and correspondence.

3. Assumes responsibility for Small Claims.

 

b. Responsible for filing all small claims cases for the Credit Union.

 

c. Responsible for filing the appropriate paperwork, monitoring to make certain service is complete, calendaring court dates and attending small claims court hearings.

 

d. Represents credit union on small claims.

 

 

4. Assumes responsibility for ensuring that professional business relations are established and maintained with Credit Union members.

a. Maintains the Credit Union's professional reputation throughout collections operations and in all contacts with members and attorneys.b. Maintains confidentiality.

5. Assumes responsibility for establishing and maintaining effective communication and coordination with Credit Union personnel.

a. Assists area personnel as needed.

 

b. Record keeping, Excel spreadsheets, and totals as requested.

 

c. Keeps management informed of activities, progress attained toward established objectives, and of any significant problems.

 

d. Attends and participates in meetings as required.

e. At times will be the responsible party for team trainings with the Credit Union.

 

6. Assumes responsibility for the efficient administration of repossessed property and foreclosed properties.

a. Documents repossession actions taken.

 

b. Directs, schedules, and coordinates legal repossession activities.

 

c. Evaluates and determines necessity for filing insurance claims on damaged repossessions.

 

d. Ensures the protection and preservation of REO properties. Coordinates approval of repairs of REO properties with Loss Mitigation Manager. e. Keeps management informed of repossession, progress attained toward established objectives, and of any significant problems.

 

f. Assists area personnel as needed.

7. Assumes responsibility for ensuring that professional business relationships are established and maintained with borrowers, buyers, the community, and with trade organizations.

a. Answers member and buyer inquiries and provides information as required. b. Ensures that requests, problems, or concerns are promptly addressed and effectively resolved. c. Ensures that the Credit Union's professional reputation is projected and maintained.

 

d. Works closely with many attorneys and manages relationships.

8. Assumes responsibility for related duties as required or assigned.

a. Stays informed of changes in collections' policies and procedures, in repossession practices, related legal and compliance requirements. b. Maintains cleanliness and security of work area, desks, and equipment. c. Ensures that changes in legal requirements and government regulations are integrated into current practices.

Qualifications

Training/Education/Certification:

• High school graduate or equivalent.

 

Required Knowledge:

 

• Thorough knowledge of collection procedures, skip tracing, and related laws and regulations.

• Thorough understanding of Credit Union loan products and policies. Knowledge of all loan contract terms and agreements.

• Familiar with deposit programs and understands account ownership.

• Familiar with collateral insurance used to protect security.

• Basic understanding of the U.S. Bankruptcy Code.

• Familiar with all legal documents relating to collection actions.

• Understanding of all court systems (Small Claims, Circuit, District, Bankruptcy). Completely familiar with equity calculations, priority of liens, and redemption rights.

Experience Preferred:

• Three to four years collection experience with a full-service financial institution.

Skills/Abilities:

• Accuracy and thoroughness in work. Ability to manage projects.

• Excellent communication, telephone, and public relations skills.

• Ability to work well independently.

• Professional attitude and appearance.

• Ability to work well in stressful situations.

• Ability to operate related computer applications, and other business equipment.
