A member of the Office of General Counsel, the Assistant General Counsel - Real Estate provides legal representation to DFCI, its executives, investigators, physicians, employees and the Board of Trustees primarily on real estate and facilities management matters and on other corporate and transactional legal matters as necessary.

Position reports to the Senior Counsel or Practice Group Lead. Position includes extensive interaction with senior administrative, medical and support staff throughout the institution, trustees, outside companies and outside counsel.

PRIMARY DUTIES AND RESPONSIBILITIES :

  • Serve as the primary internal legal contact for the Facilities Management and Real Estate team.
  • Review, draft, negotiate, interpret and advise clients on a variety of real estate-related contracts, including leases, licenses, construction documents, contractor and consulting agreements, facility-related services agreements, and other real estate documents.
  • Review and negotiate real estate-related matters for main and regional campus locations, network affiliations, and other strategic initiatives.
  • Support environmental and other regulatory compliance matters relating to DFCI properties.
  • Support planning, permitting, and contracting needs for construction and renovation projects.
  • Draft and advise on Institute policies, procedures, and other operational documents.
  • Advise on general corporate or transactional matters, which may include support in some of the following areas : patient care, faculty and professional staff, research, governance, finance, tax / nonprofit, philanthropy, privacy and security or business initiatives and alliances.
  • Stay informed of industry-specific regulations, standards, and leading practices.
  • Direct outside counsel and oversee their work.

  • Ability to successfully and independently manage multiple complex legal projects simultaneously and to thrive in a dynamic and fast-paced environment.
  • Minimum Education :

    Juris Doctor from an accredited law school.

    Minimum Experience :

    5 years of experience in law firm, corporate legal department, and / or government agency on real estate matters. Advisory experience, including direct client advisory experience in real estate matters, including experience working with and advising senior real estate, facilities, and operations executives and management professionals. Demonstrated knowledge of federal, state, and local laws involved in real estate transactions and facilities management. Experience reviewing, drafting, and negotiating real estate, construction, and facility-related contracts, advising on zoning, permitting, environmental compliance, and energy-related matters, and assessing legal risk in real estate and facilities documentation. Experience with handling disputes related to real estate projects and contracts a plus. Familiarity with nonprofit, tax-exempt organizations engaged in academic, research, and patient care operations.

    License / Certification / Registration :

    Current Massachusetts bar admission or admission in another jurisdiction with the ability to become licensed to practice in Massachusetts.
