Purpose & Job Related Requirements

  • 6,000 HIRING INCENTIVE

This position offers a one-time $6,000 hiring incentive to be paid in $2,000 increments (not added to base salary). Eligible newly-hired Attorneys in the District Attorney's Office will receive an incremental hiring incentive upon documented satisfactory job performance as follows : After successfully completing 3 months of employment (Payment #1), after successfully completing 6 months of employment (Payment #2), and after successfully completing 12 months of employment (Payment #3) for a grand total of $6,000. This incentive is not added to base salary. Continuation of this Recruitment / Hiring Incentive Program is subject to available funding and approval by the Manager.

The selected candidate(s) will be placed as an Attorney I, Attorney II, or Attorney III within the corresponding pay range depending upon qualifications. See Minimum Training and Experience Required below.

PAY GRADE : 122, 125, or 127 depending on qualifications.

P ur pose of Job

The purpose of this job is to assist the District Attorney in serving as lead counsel for the State in felony jury trials. Duties and responsibilities include, but are not limited to, preparing and presenting cases for prosecution and disposition in court; preparing sentence, plea and bond recommendations; preparing case files, evidence and witness statements; interviewing victims and witnesses and conducting law enforcement training, and performing additional tasks as assigned.

WORK SCHEDULE : Monday - Friday 8 : 00 am - 5 : 00 pm with occasional evenings and weekends required.

May be required to work on religious holidays.

Regular and predictable attendance is required.

Must work cooperatively with others.

When requirements include vehicle operation, responsible for the safety, readiness and operation of the vehicle and must abide by ACC's safe driving policy.

Minimum Training & Experience Required to Perform Essential Job Functions

Attorney I $63,736 - $75,925 Depending on qualifications (DOQ)

Minimum Requirements :

Juris Doctorate required.

Must be a member of the Georgia Bar Association in good standing and obtain a minimum of 12 hours of accredited continuing education annually.

Must possess a valid driver's license.

Experience as a law clerk, law assistant, or paralegal preferred.

An Attorney employed by the District Attorney's Office must be a current member of the Georgia Court of Appeals and the Georgia Supreme Court, or be able to obtain these memberships within six months of hire date.

Attorney II $73,783 - $87,893 (DOQ)

Minimum Requirements :

Same as Attorney I plus :

Two years of experience as a practicing attorney in two practice areas

  • Essential Duties, Responsibilities

    The following duties are normal for this job. These are not to be construed as exclusive or all-inclusive. Other duties may be required and assigned.

    Supervises the work of assigned investigators in preparing criminal court cases for trial.

    Serves as lead counsel in prosecuting assigned cases in jury and non-jury trials.

    Conducts pre-trial and motion hearings.

    Prepares and presents criminal cases to the Grand Jury.

    Directs investigations of assigned felony cases and assists investigators in identifying pertinent legal and law enforcement records and reports.

    Analyzes cases to determine if they can be successfully prosecuted; duties include examining evidence; interviewing witnesses, victims, and law enforcement personnel.

    Evaluates requests for discovery, prepares indictments of criminal charges and prepares and directs service of subpoenas and other legal papers.

    Prepares cases for prosecution; duties include reviewing evidence; reviewing and analyzing law enforcement reports, medical records and legal documents; interviewing witnesses and victims; consulting with law enforcement personnel and others; preparing opening statements and closing arguments; conducting legal research of applicable case law.

    Drafts pleas, motions, discovery documents and consent judgments.

    Approves plea and sentencing bargains.

    Prepares appellate briefs and conducts litigation before the Georgia Supreme Court and Court of Appeals.

    Prepares and directs civil forfeiture proceedings; conducts bench trials on civil forfeiture.

    Conducts hearings before the Juvenile Court and Magistrate Court.

    Conducts probation revocations in Superior Court.

    Writes correspondence and completes administrative reports and records.

    Reads legal journals and case law to maintain knowledge of legal profession.

    Performs other duties as required.

    Knowledge, Skills and Abilities

    Knowledge of the principles, practices and procedures of the Athens-Clarke County Unified Government and the operations and functions of the District Attorney's Office.

    Knowledge of legal practices, policies, and procedures as necessary in the completion of daily responsibilities.

    Knowledge of all applicable laws, ordinances, policies, standards and regulations pertaining to the specific duties and responsibilities of the job.

    Knowledge of any changes in policy, methods, operations, budgetary and equipment needs, etc. as they pertain to departmental operations and activities.

    Knowledge of computers and software as required for the position.

    Knowledge of Criminal Code of Georgia, State statutes, rules of court.

    Skill in negotiation, counseling and interviewing.

    Ability to develop and administer policies, procedures, plans and activities and to monitor performance of subordinates against measured established goals.

    Ability to develop and implement long-term goals for the department in order to promote effectiveness and efficiency.

    Ability to effectively communicate and interact with subordinates, management, employees, members of the general public and all other groups involved in the activities of the Unified Government as they relate to the District Attorney's Office.

    Ability to assemble information and make written reports and documents in a concise, clear and effective manner.

    Ability to use independent judgement and discretion in managing subordinates including the handling of emergency situations, determining and deciding upon procedures to be implemented, setting priorities, maintaining standards, and resolving problems.

    Ability to comprehend, interpret, and apply regulations, procedures, and related information.

    Ability to handle required calculations using statistical calculations.

    Ability to read, understand and interpret financial reports, case law, legal handbooks, medical reports, law enforcement reports and records and related materials.

    Ability to communicate effectively, both orally and in writing, in preparing and presenting court cases for prosecution.

    Ability to use standard word processing and / or database management software programs in performing administrative duties.

    PHYSICAL REQUIREMENTS : Must be physically able to operate a variety of machinery and equipment including standard office equipment, computer terminals, surveillance equipment and audiovisual equipment. Requires the ability to prepare legal motions and briefs, indictments, plea agreements, civil forfeiture complaints, evidence charts, legal memoranda, discovery and sentence materials, legal opinions, court calendars and other documents using prescribed formats and conforming to all rules of punctuation, grammar, diction, and style. Requires the ability to speak to groups of people with poise, voice control, and confidence.

    INTELLIGENCE : Requires the ability to learn and understand complex principles and techniques; to acquire and be able to expound on knowledge of topics related to primary occupation; and to make independent judgment in the absence of management.

    VERBAL APTITUDE : Requires the ability to record and deliver information, to explain procedures, and to follow oral and written instructions. Must be able to communicate effectively and efficiently in a variety of administrative, technical or professional languages including medical, law enforcement, and legal and accounting terminology.

    NUMERICAL APTITUDE : Requires the ability to utilize mathematical formulas; add and subtract totals; multiply and divide; utilize and determine percentages and decimals; compute discount, interest, etc; perform statistical calculations and interpret graphs.

    FORM / SPATIAL APTITUDE : Requires the ability to inspect items for proper length, width, and shape, visually with office equipment.

    MOTOR COORDINATION : Requires the ability to coordinate hands, fingers, and eyes accurately in using computers, office equipment and surveillance equipment. Requires the ability to use the keyboard, lift, bend, push, and pull objects or materials using body parts as the position necessitates.
