Assistant Attorney General – Administrative Law Division

The Tennessee Attorney General and Reporter represents all State officials, employees, agencies, departments, boards, and commissions in matters arising from their public duties. Such representation includes litigation, transactional assistance, and general legal advice to a wide variety of State entities. The Attorney General’s Office employs approximately 200 attorneys organized into 17 legal divisions within 5 sections.

About the Administrative Law Division:

The Administrative Law Division is part of the Financial and Regulatory Section of the Attorney General’s Office. The Division advises and defends various State boards and programs, including those of the Department of Health, the Health Facilities Commission, the Department of Commerce and Insurance, the Tennessee Supreme Court, the State Museum, and the Department of Tourist Development. It specializes in defending administrative agencies against challenges to their actions under the Tennessee Uniform Administrative Procedures Act (UAPA). The Division also advises and defends all state entities in matters relating to the State’s laws on open meetings and public records.

The Division’s attorneys enjoy a well-rounded workload consisting of advice and counsel, research and writing, and litigation. Due to the Division’s diverse subject matter, it also provides interesting opportunities to work closely with the general counsel for various state agencies and to develop a fulsome understanding of state regulations.

Job Overview:

Attorneys in the Administrative Law Division perform the following duties and responsibilities:

· Developing effective litigation and investigation strategies for assigned cases.

· Preparing administrative records for judicial review.

· Obtaining, providing, and evaluating oral, written, and electronic discovery.

· Pursuing effective motion practice.

· Negotiating and mediating settlements or trying cases.

· Providing sound legal advice to state agencies, entities, officials, and employees.

· Reviewing public records requests and proposed responses.

· Reviewing proposed regulations for constitutionality and legality.

· Completing assignments efficiently and on time.

The ideal candidate will have the following qualifications:

· Juris Doctorate and Tennessee bar admission or ability to apply for admission without examination.

· Demonstrated excellence in legal research and writing skills.

· Strong analytical, negotiating, and oral advocacy skills.

· Five or more years practicing law, with at least some litigation experience.

· Familiarity with administrative law in Tennessee and matters arising under the UAPA and/or TPRA.

· The ability to work as part of a team and to explain legal issues to non-attorneys.
