About the Deputy Compliance and Privacy Officer position:
Reporting to the Chief Compliance Officer, the Deputy Compliance and Privacy Officer will serve as a healthcare regulatory compliance subject matter expert, as well as Privacy Officer as required by applicable privacy laws. This position is primarily responsible for the effective design, operation, and maintenance of all compliance program policies, procedures, and controls. This role will ensure compliance with all federal and state laws, including HIPAA and HITECH requirements, licensing requirements, and internal compliance policies/procedures. This position will implement appropriate initiatives, policies and processes, risk assessments, compliance related reports, education/training, and audit/monitoring. The Deputy Compliance and Privacy Officer will investigate reports of non-compliance and monitor corrective action plans.
This position is eligible for remote work, but quarterly travel to the corporate office in Tampa, Florida is required.
Deputy Compliance and Privacy Officer– Essential Functions and Responsibilities:
- Provide oversight and direction in the development of all aspects of the compliance program;
- Prepare and present material for the quarterly Compliance and Quality Committee meetings, including coordinating contributions to the meeting from other departments, prepare meeting minutes;
- Serve as Privacy Officer;
- Investigate and document possible unauthorized disclosures of Protected Health Information;
- Notify covered entities of any unauthorized disclosure or breach of their Protected Health Information;
- Develop and present compliance related content at All Associate meetings;
- Oversee FDR compliance;
- Oversee monthly exclusion and Preclusion Checks;
- Oversee the administration of all new hire training and annual training and overseeing the maintenance of records of the same;
- Draft (or oversee) new compliance policies, the performance of the annual policies reviews, and the updating of compliance training materials;
- Coordinate with relevant business partners to develop and revise business policies and ensure business policies are being appropriately enforced and monitored;
- Manage Avalon's conflict of interests policy, including overseeing the tracking of potential conflicts of interests and the reporting of the same;
- Oversee maintenance of sanctions log;
- Oversee/participate in Avalon's responses to compliance and privacy audits;
- Participate in Avalon's third-party vendor oversight program to promote compliance with all regulatory requirements including, but not limited to first tier, downstream, and related entities (FDRs);
- Develop audit tools, plans, and schedules, and conduct compliance readiness audits as it relates to all new business functions;
- Develop and implement risk assessment tools to identify potential deficiencies and facilitate development, monitoring, and implementation of corrective action plans;
- Serve as the compliance subject matter expert on all business functions to internal and external stakeholders;
- Serve as the compliance liaison with government regulators to receive state or federal correspondence or alerts on new initiatives;
- Work across teams and departments, balancing competing objectives to accomplish goals and requirements;
- Gather and respond to all regulatory, or compliance audit requests for information; and
- Use professional judgment and institutional knowledge to assess risk levels, conduct approved investigations, provide guidance on remediation planning, and prioritize remediation efforts.
Deputy Compliance and Privacy Officer – Minimum Qualifications:
- Bachelor's degree (may consider relevant work experience in lieu of a degree);
- Compliance certifications preferred but not required, e.g., CHC (Certified in Healthcare Compliance), CHPC (Certified in Healthcare Privacy Compliance);
- Expert knowledge of the Health Insurance Portability and Accountability Act (HIPAA Privacy Rules);
- 8 years of healthcare compliance analyst experience;
- Strong working knowledge of laws, regulations, and related matters relevant to the operations of health plans; and
- Excellent interpersonal skills with ability to maintain effective working relationships with all levels of management and ability to excel in a team environment.
Deputy Compliance and Privacy Officer– Preferred Qualifications:
- 10 years general experience in a health care organization.
