SUMMARY: The Collection/Foreclosure Paralegal’s role is to provide support to the Attorney with the processing of substantive legal work, in addition to understanding and complying with the provisions of the Fair Debt Collection Practices Act, Florida Condominium Act and related state laws.

Duties/Responsibilities
Association Actions
- Understand and comply with the provisions of the Fair Debt Collection Practices Act and related state laws.
- Communicate with delinquent owners via phone, email, and letter correspondence respectfully and professionally.
- Process payments from owners and prepare balance due letters, payoff letters, and estoppels.
- Prepare initial Demand Letters, Notice of Intent to Foreclose letters, and Liens.
- Prepare and generate the complaint packages.
- Prepare and generate all foreclosure motions.
- Prepare and generate Stipulations for Settlement, if necessary, including the Order Ratifying the Stipulation.
- Prepare and generate the Motion for Summary Judgment, including the affidavit of indebtedness and the affidavit of costs. The affidavit of attorney's fees will be initially prepared and generated by the Team Assistant but will be completed by the Paralegal by confirming that the information is correct and by adding the estimated attorney's fees incurred to finish out the action.
- Prepare and generate all Notices of Hearing.
- Instruct Team Assistant with various tasks.
- Prepare and generate the Final Judgment, including the Notice of Sale.
- Prepare cover letters to the judge.
- Prepare the hearing folder for the attorney to take to the hearing.
- Pull Mortgage/Satisfaction Search.
- Prepare Answer/Affirmative Defenses.
- Prepare and generate any Motions for Case Management Conference, Notice of Trial, and Motions to Reschedule Sale.
- Prepare and generate all Notices of Hearing.
- The Paralegal must ensure all legal work is complete for the file to be closed and that there are no outstanding invoices to be paid. If there are outstanding invoices, determine if there is money in trust to pay the invoice. Give the file to the Team assistant to prepare the check request, or if no money is in trust, prepare the additional funds request.
- If there is money in trust for another matter, contact the Association to obtain consent to use the funds for payment of the invoice.
- Receive Court Pleadings filed.
- Save the document in the file through Filesite for further profiling by the file clerk.
- Must be proficient in software tools, including but not limited to Word, Excel, Outlook, and the Internet.
- Must possess strong written and verbal communication skills.
- Must provide excellent customer service to internal and external customers.
- Identifies and solves issues in a timely manner.
- Must be a team player and willing to help others in their department whenever necessary.
- Must be extremely organized and able to multi-task.
- Conscientious with respect to work completion, deadlines, time management, and attendance.
- Analytical and detail-oriented, while working at a fast pace and capable of multi-tasking.
- High School Diploma required; Bachelor’s Degree preferred.
- 2 or more years of experience.
