Summary:

POSITION SUMMARY

The Trade Compliance Analyst III supports import and export activities and procedures that ensure compliance with local and international laws and regulatory regimes as applicable to the movement of goods internationally.

Responsibilities:

PRINCIPAL RESPONSIBILITIES

IMPORT ACTIVITIES

· Manage/coordinate daily import and compliance activity.

· Review/audit of Customs import entry submissions with request for any corrections with Benchmark’s brokers.

· Request and follow through on any post summary corrections of entries.

· Provide clearance instructions to brokers.

· Classify commodities for an HTS classification.

· Support HTS classification through knowledge and understanding of all GRI’s, Explanatory Notes, Chapter and Section Notes

· Monitor ACE reports for import entries and reconciling information.

· Provide valuation assistance/guidance to supply chain, when required.

· Thorough understanding of Rules of Origin and issuance of Certificates of Origin when applicable.

· File all ISF information when required.

· Participate in Corporate quarterly audits of Customs entries.

· Understand government agency requirements upon importation (FDA, FCC, TSCA, and CVD/ADD).

· Perform complex analysis and research of rules of applicability through knowledge of the USMCA (GN11)

· Assure USMCA claims are proper and valid.

· Apply Preferential Rules of Origin for Free Trade Agreements, when applicable.

· Effectively communicate with U.S. Customs in response to CF28/CF29 requests.

· Perform and file both Value and USMCA Reconciliation with U.S. Customs.

· Provide monthly cost report of duties paid and duties avoided to management.

· Manage the End User Certification process with all Suppliers

· Assist the Trade Compliance Manager on processing/submission of Value and USMCA Reconciliation

· Basic customer contract review for responsibilities/liabilities

· Management of customs bond activity

· Write and provide t raining to employees on import matters.

· Work with supply chain on any import matters.

· R etain all import documentation according to recordkeeping rules and the Import Management and Compliance Program manual.

· Maintain and update ERP system and/or parts database with HTS, Origin and OGA information.

· Assist with writing i mport procedures and work instructions.

· Keep brokers updated with the current part database.

· Participate in Corporate annual Risk Assessments for Import Program.

· Participate in site import disclosures with Corporate Trade Compliance team.

· Knowledge and ability to apply rules of origin for Free Trade Agreements and assisting the Trade Compliance Manager in rules of origin for various government programs.

EXPORT ACTIVITIES

· Maintain knowledge of compliance to the EAR, the FTR and ITAR.

· Assist in review and/or writing export procedures.

· Work with Corporate Trade Compliance Management on any potential export compliance matters.

· Manage the Customer Document Vetting portal

· Manage the End User Certification process with all U.S. Benchmark customers

· Manage the export licensing log process

· Knowledge of export license exceptions and how to apply them on restricted exports

· Maintain the export license exception log when applicable.

· Prepare complex U.S. Department of Commerce licenses and/or export authorizations.

· Assist Corporate Trade Compliance Managers on managing of Annual Sales Reports for Dept of State agreements

· Conduct export classification (ECCN/USML) of documentation and/or products.

· Share updated, current parts database with brokers.

· Perform denied parties checks on business partners.

· Manage and coordinate daily export activity.

· Review and/or maintain site export documentation.

· Participate in Corporate quarterly export audits.

· Participate in Corporate annual Risk Assessments for Export Program.

· Participate in site export disclosures with Corporate Trade Compliance team.

· Assist Corporate Trade Compliance Manager on ruling requests and/or CCATs.

· Other compliance related duties as assigned.

· Assist with international transitions.

· Write and provide training to employees on export matters.

· Maintain and update classification information (ECCN, USML and licensing) in local part database and/or ERP system.

KNOWLEDGE, SKILLS & ABILITIES

Education / Experience

· Customs Broker license or Export Compliance Certification which has renewal requirements involving additional training annually or bi-annually

· B achelor’s degree and/or 7 o r more years of export /import experience preferred

· Knowledge/Familiarity with “maquiladora/IMEX” operations a plus

· Knowledge/Familiarity working in an ERP system a plus

Abilities

  • Must be able to lift, carry, push, or pull up to 5 pounds 5% or less of the workday
  • Must be able stoop, kneel, crouch, or crawl 5% or less of the workday
  • Must be able to talk, see, hear, concentrate, think, and reason
  • Must be able to sit for prolonged periods of time throughout the workday.
  • Must be able to use a keyboard and do manual tasks for prolonged periods of time throughout the workday.

· Location can be Phoenix-Tempe, Rochester-Winona or Huntsville; remote or hybrid schedule; team environment
