Role Summary
We are seeking a Trademark Counsel with approximately 3-5 years of experience to join our in-house legal team.
This role will focus primarily on domestic trademark clearance, prosecution, and enforcement, with opportunities to assist in marketing and advertising law matters as needed.
The ideal candidate is a collaborative, business-minded attorney who can navigate a fast-paced environment, work cross-functionally with marketing and product teams, and help protect and strengthen our portfolio of famous consumer brands.
Key Responsibilities
- Oversee domestic trademark clearance and prosecution, including analyzing search results and providing legal opinions on trademark availability.
- Manage U.S. trademark filings, including reviewing and supervising paralegal work.
- Assist with U.S. enforcement efforts, including handling trademark oppositions, cancellations, and litigation support.
- Draft and respond to cease and desist letters and coordinate with outside counsel as needed.
Advertising & Marketing Support (as needed)
- Provide strategic trademark and copyright guidance on advertising, promotional materials, social media campaigns, and influencer marketing.
- Assist in the review of marketing claims and substantiation in packaging and advertising materials and risk assessment for brand communications.
Transactional & Other Responsibilities
- Support M&A transactions, including trademark due diligence, agreement review, and post-closing brand integration.
- Assist in managing our trademark licensing program, including reviewing license agreements, and ensuring brand compliance.
- Provide general copyright guidance related to brand assets and creative content.
Qualifications & Experience
- 5 - 7 years of experience as a trademark attorney in a law firm or in-house legal department, preferably with experience in the consumer products industry.
- Strong experience in trademark clearance, prosecution, and enforcement.
- Member of the New Jersey Bar or eligible for an in-house counsel license.
- Ability to work independently, manage multiple priorities, collaborate effectively with business teams, and adapt quickly changing circumstances.
- Excellent communication skills and a practical, business-friendly approach to legal problem-solving.
- Effective oral and written communication skills.
- Ability to work and interact with corporate management and others at all levels.
- Demonstrate strong change leadership, client development, judgment, analytic, organization and implementation skills through successful development, implementation, and improvement of fundamental processes across functions/organizations.
- Demonstrated broad business orientation and ability to aggressively establish instant credibility as an attorney, change agent, and business partner with a cross functional perspective.
