Minimum starting salary is $121,455. A higher salary may be offered depending on the selected applicant's relevant experience.

General Description
The Assistant City Attorney provides legal counsel and representation to the City and/or the Murfreesboro City Schools. The position requires an individual who is a skilled professional capable of exercising independent judgment and who possesses excellent legal research, writing, and oral communication skills. The individual must have high personal and professional ethical standards and have the personal disposition and character necessary to work effectively with individuals from all levels of the organization (including elected and appointed officials), within the legal community, in judicial forums, and with members of the public. The Assistant City Attorney reports to the City Attorney and works under the general supervision of the City Attorney and/or Deputy City Attorney.

EXAMPLES OF ESSENTIAL DUTIES

Essential Functions:

Must be able to communicate with others in spoken and written English to ensure the safe and efficient operations of the business.

Provides legal representation and advice to the City and Murfreesboro City Schools (collectively, “City”), through their officials, employees, boards, and commissions, privately and at public meetings, on a variety of complex legal topics.

Drafts and reviews ordinances, resolutions, policies, administrative directives, general orders, and forms to ensure compliance with applicable laws, often developing these documents collaboratively with other City employees.

Prepares and reviews contracts and other legal documents in connection with procurements and a wide variety of real estate and other transactions and when requested assists with negotiation of these transactions.

Responds to legal inquiries by City officials and staff often requiring legal and factual research and preparation of written opinions. Researches and analyzes complex legal issues and prepares legal advice relative to a broad variety of areas of the law including municipal law, employment, regulatory compliance, constitutional, public safety, real estate, zoning, land use, contract, collections, tax, bankruptcy, tort, education, and workers’ compensation.

Performs one or more of the following, as assigned by the City Attorney:

Represents the City in federal, state, and City courts, handling all aspects of litigation brought by or against the City, including pleadings, discovery, motions, trial, and appeal.

Represents the City in federal, state, and local administrative hearings.

Handles real estate transactions, including the preparation of contracts, leases, easements, deeds, trust deeds, instruments of title, liens, releases, and other documents; conducting title examinations; coordinating the services of surveyors, appraisers, and engineers; and negotiating the terms of transactions with property owners, tenants, and attorneys.

Provides legal counsel to the Murfreesboro City Schools.

Additional Duties:
Supervises the work of Legal Assistants.

Coordinates or supervises the work of outside counsel.

May be required to perform the duties and handle the responsibilities of City Attorney in City Attorney’s absence.

Performs other work as assigned.


Physical Demands:

Performs sedentary work that involves walking or standing some of the time and involves exerting up to ten (10) pounds of force on a regular and recurring basis or sustained keyboard operations.

TYPICAL QUALIFICATIONS

Minimum Education and Experience Requirements:
Requires a Doctor of Jurisprudence degree and at least four (4) years of experience handling civil legal matters. Prior experience in one or more of the following areas is strongly preferred: (1) land use and real estate law; (2) procurement and purchasing; and/or (3) municipal law.
Special Certifications and Licenses:
Must be licensed to practice law in Tennessee or be eligible for admission to practice in Tennessee within six (6) months of employment.

HEALTH AND WELFARE BENEFITS

Eligibility

Wait Period
Benefit coverage begins on the first day of the month following or coinciding with a 60-day elimination period.

Payroll Deductions
Payroll deductions for your elected benefits, including FSA, are deducted current for the effective period of the coverage. Example: Your May benefit coverage is payroll deducted in the month of May, June is deducted in June, etc.

MEDICAL
Medical care and hospitalization benefits are provided by Blue Cross Blue Shield of TN (BCBST). Employees may choose from either a PPO or HRA plan design based on which plan best serves their personal needs. The City pays a portion of the employee’s total insurance premium for both plans, including enrolled dependents. The employee’s shared portion will be payroll deducted on a pre-tax (tax-free) basis.

DENTAL
Dental coverage is provided by Delta Dental of Tennessee. The plan provides coverage for the prevention of dental diseases and problems, designated restoration and repair procedures, and orthodontics. The City pays a portion of the employee’s total insurance premium for both plans, including enrolled dependents. The employee’s shared portion will be payroll deducted on a pre-tax (tax-free) basis.

VISION
Vision coverage is provided by Blue Cross Blue Shield of TN, EyeMed. The plan provides coverage for annual eye exams, frames, and lenses. The vision benefit plan is 100% employee-paid by payroll deductions, on a pre-tax (tax-free) basis.

FLEXIBLE SPENDING ACCOUNTS (FSA)
The City offers a Healthcare FSA and a Dependent Care FSA benefit (Section 125 Cafeteria Plan) through PayFlex allowing insurance premiums, copays, and certain medical and dependent care expenses to be paid with pre-tax dollars on an annual set-aside basis per the annual amount selected (payroll deduction amounts are based upon number of pay dates in, or remaining in, a year). Employees are allowed to rollover up to $610 to the next plan year (2025).

LONG TERM DISABILITY (LTD)
Long Term Disability insurance is provided through Madison National to employees at no cost. In the event a full-time employee becomes totally disabled, after a 90-day elimination period, the employee shall be entitled to receive monthly disability benefits equal to 60% of the employee's pre-disability monthly compensation. The City coordinates with Social Security, in that, the LTD benefit and SS amount combined equals 60% of the pre-disability monthly salary.

SHORT TERM DISABILITY (STD)
Voluntary Short Term Disability insurance is available to employees through Aflac to help with out-of-pocket expenses in the event you experience an off-the-job Accident or Sickness. Options available to choose from are: (1) 0/7 days elimination period for Accident/Sickness, (2) 7/14 days elimination period for Accident/Sickness, or (3) 14/14 days elimination period for Accident/Sickness. The maximum benefit period per claim is 3 months, or 12 weeks. Pre-existing exclusions may apply. The STD benefit plan is 100% employee-paid by payroll deductions.

BASIC TERM LIFE & ACCIDENTAL DEATH & DISMEMBERMENT (AD&D)
Life and AD&D insurance is provided through Minnesota Life at no cost to the employee. Named beneficiary(ies) will be paid Basic Term Life insurance benefits in the amount of two (2) times the employee's annual budgeted salary rounded to the next $1,000, with a benefit maximum of $350,000. Accidental Death and Dismemberment is equal to the amount of the employee's Basic Term Life coverage amount. The AD&D coverage reduces at age 70 by 50%.

SUPPLEMENTAL VOLUNTARY LIFE
Voluntary Term Life benefits is available to employees, spouses, and their eligible dependents through Minnesota Life. Premium amounts for employees and spouses are based on age and the amount of coverage selected. Newly hired employees’ (only) guaranteed issue amount cannot exceed $250,000 (no health questions asked), with their spouse guaranteed up to $50,000. The maximum coverage allowed for employees is $500,000, and for their spouse, $250,000. Employee and spouse coverage is subject to underwriting. Child Term Life is guaranteed up to $20,000 (birth to age 26) for each child, with increments available in $10,000, $15,000, and $20,000.

Employees are eligible to enroll in the City’s personalized Wellness and Rewards Program, administered by Sonic Boom Wellness. Sonic Boom makes it easier to get moving along your path with multiple ways to stay active: personalized activities, access to fitness tools and resources, healthy habits, and fitness tracking. Connect your personal fitness tracker to the Sonic Boom mobile app to earn points - fitness points turn into reward dollars to shop with! Spouses are eligible to enroll in the City’s Wellness Program; however ineligible to earn points for rewards.

EMPLOYEE ASSISTANCE PROGRAM (EAP) – Eligible on Hire Date!
Your mental health and wellbeing matters!

Full-time employees, their spouse, and dependents have immediate access to the City’s Employee Assistance Program (EAP), LifeServices EAP, at no cost to the employee. The EAP gives you access to 24/7 confidential counseling, support, and personalized content from any device; it is designed to help you deal with problems that would otherwise distract you from your day-to-day activities. Types of work-life benefits include, but not limited to, adoption assistance, elder care, grief and loss, teen issues, addition, moving, travel.

Employee and eligible family members are each provided up to 6 consultation visits, per episode, per contract year. Services are delivered by phone, video-based counseling, and in-person sessions. A live Chat is also available in your member portal.

Police and Firefighters receive an additional 12 visits if necessary.

RETIREMENT & SAVINGS BENEFITS
Eligibility
Full-time employees regularly scheduled to work a minimum of 30 hours per week.

Wait Period
After a 60-day elimination period, Retirement Plan participation begins on the first day of the month.

MISSION SQUARE RETIREMENT PLANS – For Employees Hired After July 1, 2010
  • 401(a) PlanMandatory Participation: Employees hired after July 1, 2010, are required to participate in a 401(a) Plan with a mandatory contribution of a 3% pre-tax deferral amount, administered by Mission Square. The City will contribute a matched amount of exactly 3%. You do not pay taxes on the money in your account until you withdraw it.
  • 457 PlanOptional Participation: A voluntary 457 retirement plan through Mission Square is available for employees who want to contribute an additional amount to a nonqualified, tax advantaged deferred-compensation plan. The 457 Plan is designed to help you meet your retirement goals. The maximum annual contribution in the 457 Plan cannot exceed the IRS maximum, including the City’s contributions. The City will provide an equal match, up to 5% of salary, for an employee's voluntary 457 contribution.
IMPORTANT NOTE: The City's total contribution match amounts for both 401(a) and 457 Plans will not exceed a combined 8%.

Vesting
  • You are always 100% vested (own) for all contributions you make.
  • Your ownership of the City’s contributions is based on a vesting schedule:
    • Employees hired after July 1, 2010, are 100% vested in the Mission Square Retirement Plans after 5 years of completed service, based upon hire date.
    • Employees hired prior to July 1, 2010, are vested either 5 years from hire date, or 5 years from their plan entry date, which could be the first of the month following, or coinciding with, 90 days from their hire date.
Retirement Age
  • Police Officers and Firefighters Only: The employee’s 55th birthday is “Normal Retirement Age”
  • All Other Employees:
    • At least 55 years of age, and on the date of completing thirty (30) years of full-time service, OR
    • On 65th birthday
CHRISTMAS CLUB SAVINGS PROGRAM – Eligible on Hire Date!
Employees may elect to enroll into a ‘Christmas Club’ savings program by electing a dollar amount for payroll deduction every pay date, which will be transmitted to an established bank account with Pinnacle Bank. You will receive monthly statements from Pinnacle Bank. Christmas Club funds are automatically funded to you every November from Pinnacle Bank in the form of a check, mailed to your home address.

CREDIT UNION BANKING – Eligible on Hire Date!
City of Murfreesboro full-time employees can join a local Credit Union at one of the following banks:
  • Ascend Federal Credit Union
  • Cornerstone Financial Credit Union
  • Redstone Federal Credit Union
  • Heritage South Credit Union

Present your City of Murfreesboro employee I.D. for guaranteed acceptance in local membership banking.
Note, credit union banking is not required and existing credit union memberships from other banks are accepted.

LONGEVITY PAY – Must be on City’s budget one year prior to eligibility
The City of Murfreesboro may give a discretionary bonus, authorized by the Mayor and City Council, each year. It is a means by which long-term, full-time employees can be rewarded based on the length of continuous service. Longevity pay is calculated by multiplying the total years of continuous service by a dollar amount, if any, to be approved by the Mayor and Council. Longevity is paid on the first Friday of the month of December of the current year.

Examples: (1) Employees hired on or before July 1, 2022, will be eligible for Longevity pay, if any, in December 2023, (2) Employees hired on or before July 1, 2023, will be eligible for Longevity pay, if any, in December 2024.

PAID TIME OFF BENEFITS
PAID HOLIDAYS – Eligible on Hire Date!
The City observes eleven (11) paid holidays each year:

Holiday hours for regular, full-time employees are paid based on an employee’s annual hours worked schedule, per the following:
1,950 annual worked hours = Receives 7.5 hours of Holiday pay
2,080 annual worked hours = Receives 8.0 hours of Holiday pay
2,808 annual worked hours (Fire Shift Employees Only) = Receives 12.0 hours of Holiday pay

Employees scheduled to work 4 days per week, 10 hours per day (4/10s) will receive 8.0 hours of holiday pay.

Fire shift employees assigned to work a 24-hour shift will receive 12.0 hours of holiday pay.

PAID VACATION LEAVE – Eligible on Hire Date; hours earned daily!
Vacation Leave is accrued (“earned”) by all regular, full-time employees who are actively at work, per pay period, and based on total hours paid (including hours worked over the employee’s regular schedule, and as defined by the City’s polices). Vacation Leave will be accrued if employee is out on a type of paid time off.

Vacation Leave hours may be taken once earned and are scheduled based on the employee’s regular work shift (e.g., a 7.5-hour workday schedule will accrue Vacation at a 7.5-hour accrual rate and may be scheduled daily at a maximum of 7.5 hours). Vacation requests (partial or full day) must be approved by the Department Head.

As an employee’s length of service increases, the accrual rate for Vacation will increase as well. Accrued, unused Vacation hours at year-end will roll over into the new year.

The following table represents the Maximum Possible Days and/or Fire Shifts that can be accrued per year based on years of employee’s completed service:


If an employee’s total, scheduled annual hours is achieved prior to their employment anniversary date, Vacation Leave accruals will stop at the time the total annualized hours are achieved Example: Employee is scheduled to work 1,950 hours annually. Employee accumulates 1,950 total hours worked before their anniversary date; therefore, Vacation accruals will be suspended until the employee’s anniversary date.

PAID SICK LEAVE - Eligible on Hire Date; Hours earned per pay period!
Sick Leave is accrued (“earned”) daily by regular, full-time employees who are actively at work, per pay period, based on hours worked and paid (includes all hours worked, including hours worked over the employee’s regular schedule, and as defined by City’s polices). Sick Leave is accrued if employee is out on a type of paid time off.

Employees can earn up to 8 Sick Leave hours per month and up to an annual maximum of 96 Sick Leave hours. Firefighters earn up of 12 hours of Sick Leave per month. Sick Leave hours may be taken once earned and are based on the employee’s regular scheduled work shift per day, i.e., 7.5 hours per day or 8 hours per day.

Accrued, unused Sick hours at year-end will roll over into each new year.

Pay Frequency, Work Week, & Pay Method
Paydays for employees occur biweekly. City Council and Board Members are paid monthly. Employees may choose to receive pay either by direct deposit or by payment on a bank debit card.

The City of Murfreesboro encourages, recognizes and rewards service excellence by its employees. This program is intended to: recognize outstanding full-time and part-time employees who embody the City’s standards for service excellence and exemplify our core values. Employees are nominated by either co-workers or citizens, and the award’s recipients are selected by an Awards Committee.

An employee, or employee team, selected for the STARS award will, at minimum, if full-time, receive one day of paid Vacation Leave and, if part-time, receive a monetary award. Public recognition of this award occurs at City Council meetings.
