The City of Plano is seeking an Assistant City Attorney II or III to join our team in the Prosecution Office of the City’s Legal Department. In this role, you will apply your legal expertise and trial skills in prosecuting Class C Misdemeanor offenses, including violations of City Ordinances and State laws, in both Municipal Court and appellate courts.

The successful candidate may be offered a position in either the Assistant City Attorney II or the Assistant City Attorney III classification. The salary range for the for the Assistant City Attorney II is $65,187 – $94,515 annually; and for the Assistant City Attorney III is $87,339 – $126,651 annually.
Assistant City Attorney II (The job description for the Assistant City Attorney III is listed below.)
Summary of Duties : Under basic supervision, the Assistant City Attorney II - Prosecution performs municipal legal work, including prosecution of Class C Misdemeanor offenses; represents the State of Texas and City of Plano in Municipal Court and appellate courts; prepares legal documents; performs legal research and writing; and assists with supervision of Municipal Court operations and prosecution staff.
Distinguishing Characteristics : This is the journey-level classification in the Assistant City Attorney Prosecution series that follows diversified procedures and implements processes to accomplish end results, within guidelines. Immediate supervision is available when appropriate, but this class requires less supervision and training than Assistant City Attorney I - Prosecution, which is a lower-level class in the series. This class is distinguished from Assistant City Attorney III - Chief of Prosecution in that the latter is a higher-level class in the series and performs more complex technical, investigative, and supervisory duties requiring a higher level of knowledge and skill.

Minimum Qualifications:
Knowledge of: Texas criminal law, procedures and rules of evidence as they relate to a Municipal Court of record, appeals and applicable constitutional provisions; laws directly or indirectly affecting City government; laws affecting municipalities, including but not limited to the Public Information Act and Texas Local Government, Government, and Health and Safety Codes, for purposes of civil code enforcement, procurement, and contracting regulations.
Skill in: Prosecuting all aspects of Class C Misdemeanor cases in a Municipal Court of record and on appeal; demonstrating highly effective analytical, organizational, verbal and written communications skills; interpreting codes, ordinances, statutes and legislation; drafting effective ordinances, pleadings and legal documents.
Education: Graduation from an accredited law school.
Experience: At least one year of legal experience with exposure to criminal, municipal or government law preferred.
Any work-related experience resulting in acceptable proficiency levels in the above Minimum Qualifications is an acceptable substitute for the above-specified experience requirements
Licenses and Certifications: Must be licensed to practice law in the State of Texas.
Conditions of Employment: Must pass a drug test, crim inal history background check, periodic CJIS background check (for positions requiring access into Police buildings) and social security number verification check.
Assistant City Attorney III
Summary of Duties: Under general supervision, the Assistant City Attorney III - Prosecution performs municipal legal work, including the effective prosecution of cases in Municipal Court, including appeals therefrom; supervises municipal court operations and staff; prepares legal documents including contracts, ordinances and resolutions as directed by senior attorneys; responds to public information requests as assigned; performs legal research and writing and related work.
Distinguishing Characteristics: This is the advanced journey-level classification in the Assistant City Attorney - Prosecution series. The incumbent plans detailed methods to attain desired objectives working within established policy. Methods require use of initiatives and resourcefulness in developing processes and procedures. Works under indirect supervision, conferring with supervisor on unusual matters.

Education: Requires graduation from an accredited law school.
Experience: Four (4) years of recent prosecution experience involving criminal and code offenses. Municipal court of record experience preferred.
Any work-related experience resulting in acceptable proficiency levels in the above minimum qualifications is an acceptable substitute for the above specified experience requirements.
Licenses and Certifications: Must be licensed to practice law in the State of Texas.
Conditions of Employment: Must pass a drug test, criminal history background check, periodic CJIS background check (for positions requiring access into Police buildings) and social security number verification check.
Physical Demands and Working Conditions: This is primarily a sedentary office classification although standing in work areas and walking between work areas may be required. Finger dexterity is needed to access, enter, and retrieve data using a computer keyboard or calculator and to operate standard office equipment ; vision to read printed materials and a computer screen; hearing and speech to communicate in person and over the telephone . Positions in this classification occasionally bend, stoop, kneel, reach, push, and pull drawers open and closed to retrieve and file information. Employees must possess the ability to lift, carry, push, and pull materials and objects weighing up to 25 pounds .
Employees work in an office environment with moderate noise levels, controlled temperature conditions, and no direct exposure to hazardous physical substances. Employees may interact with upset staff and/or public and private representatives in interpreting and enforcing departmental policies and procedures.

- Serves as the Chief Prosecutor responsible for the effective preparation and prosecution of criminal cases in the Municipal Court and appeals therefrom; advises, supervises, and reviews the work of an Assistant City Attorney I or II as applicable , who serves as the primary prosecutor; supervises the Municipal Court staff.
- Provides legal expertise in the area of Municipal Court prosecution including, but not limited to, violations of the City of Plano Code of Ordinances, State criminal statutes related to class C offenses prosecuted by the city, and criminal procedure and process related to a municipal court of record including appeals.
- Represents the City of Plano and State of Texas in Plano Municipal Court; supervises and reviews staff work including reports, records, evidence, electronic recordings, appellate documents, and the evaluation and preparation of witnesses.
- Under the supervision of a higher level attorney, works on special projects; reviews and adopts practices and procedures with judges, clerks, and other staff involved in criminal prosecution.
