Description

  • The entire range of pay for this position is posted. Typical starting pay will be at the beginning of the range, depending on qualifications.

Primary Purpose

Supports the City Attorney and Prosecuting Attorney by performing duties related to the prosecution of traffic offenses and other ordinance violations in Municipal Court and by performing various duties related to the City Attorney's provision of legal representation to the City, City Council and Mayor. Works directly with the City Attorney and City Prosecutor by helping on a variety of tasks as directed, including the preparation of legal documents, plea agreements, discovery responses, motions and other pleadings, contracts, resolutions, ordinances, and other key documents / correspondence. Actively assists with weekly dockets held in Municipal Court by managing preparation of plea offers and other papers in advance of court appearances, and by assisting with communications in court with defendants, alongside the Prosecuting Attorney.

Under the direct supervision of the City Attorney and Prosecuting Attorney.

Essential Duties & Responsibilities

  • Assists with preparation and revision of various documents including (but not limited to) City Ordinances and Resolutions, City Code, City Council Agendas, policies, and procedures. Scans and enters documents into databases utilized by the City Clerk and the Legal Department, distributes original(s) and copies, as necessary.
  • Works closely with the City Clerk to track and complete various tasks and projects submitted through the formal attorney review process.
  • Assists the City Attorney with preparing training materials such as informative handouts, PowerPoint presentations, or other correspondence, intended for City staff or City Council members.
  • Responsible for making the required redactions under applicable Missouri Supreme Court Operating Rules on documents being filed with the Municipal Court by the City Prosecutor.
  • Responsible for the proper accessing, safeguarding and handling of restricted information including, but not necessarily limited to, police reports, laboratory reports, investigative reports, criminal history information and other law enforcement records, in connection with assisting the City Prosecutor on Municipal Court cases.
  • Receives and tracks requests for plea recommendations in Municipal Court cases. Prepares plea offers at the direction of the Prosecuting Attorney and responds to requests for the same, as instructed. Ensures all necessary documentation for Plea Agreements is prepared for execution in advance of the scheduled court dates.
  • Utilizes specialized police department records management system for review, redaction, and preparation of records for disclosure to defense counsel in Municipal Court cases; Obtains digital and photographic evidence for producing in discovery, at the direction of the Prosecuting Attorney.
  • Assists with preparation and filing of certain pleadings, notices, and certificates with the Municipal Court at the direction of the Prosecuting Attorney.
  • Monitors active Municipal Court cases to assist the Prosecuting Attorney with preparation for upcoming trials or other scheduled hearings.
  • While Municipal Court is in session, is responsible for :
  • Handling initial communications with defendants wishing to speak with the Prosecuting Attorney's Office to gather relevant information and / or documentation pertaining to their cases.

  • Providing information obtained from defendants to the Prosecuting Attorney for use in preparing a plea offer or other disposition recommendation.
  • As needed, assisting with the preparation of plea offers to present to defendants, at the direction of the Prosecuting Attorney.
  • Obtaining police reports and other case evidence, such as digital media, at the request of the Prosecuting Attorney.
  • Instructing defendants on the procedure for paying restitution to victim(s).
  • Manages the receipt and distribution of restitution payments made in Municipal Court cases.
  • Tracks probation sentences imposed in Municipal Court cases to ensure compliance with terms and conditions. Reports potential violations of probation conditions to the Prosecuting Attorney and assists with drafting and filing motions to revoke probation with the Municipal Court, if appropriate.
  • Manages communication with victims in Municipal Court cases regarding damages related to restitution, and regarding key court appearances in their cases.
  • Assists in the creation and implementation of new or improved procedures within the City's Legal Department, as directed by the City Attorney.
  • Deals effectively and courteously with fellow employees and the public.
  • Performs other duties as assigned.
  • Important Duties

  • Perform a variety of administrative / office tasks, such as copying, filing, faxing, scanning, printing, retrieving and sending mail.
  • Responds to miscellaneous inquiries on policies and procedures, as necessary.
  • Attends in-service training sessions or other training sessions as deemed appropriate.
  • Maintains appropriate supplies for assigned work areas.
  • Maintains a neat and orderly work area.
  • Minimum Qualifications

    Education & Experience

  • Must be a high school graduate or equivalent. Related higher education preferred.
  • Must have at least two (2) years of experience as a paralegal, legal assistant, or equivalent.
  • Experience in drafting and filing legal pleadings with the Court system using the Missouri Case.net filing system preferred.

  • Experience handling communications with parties to litigation (i.e., plaintiffs or defendants in court cases), attorneys representing parties in litigation, and other legal support staff handling litigation cases preferred.
  • Paralegal certification that meets the paralegal education standards recognized by the American Bar Association (ABA) preferred.
  • Experience in reviewing or drafting ordinances, resolutions, and other documents utilized in connection with proceedings held before the governing body of a political subdivision (i.e., a City Council, school board, Board of Alderman, etc.) preferred.
  • Knowledge, Skills & Abilities

    Must be knowledgeable in the basic math skills of addition, subtraction and multiplication. Must communicate effectively and professionally both verbally and in writing. Must have the ability to discern tasks that can be performed independently and tasks that warrant guidance or direction. Must demonstrate respect and acceptance for differences among City employees and citizens. Must complete work accurately and timely. Must have knowledge of business correspondence formats, record keeping, and filing system methods. Must have a working knowledge of Microsoft Word, Microsoft Excel, Adobe and AdobeSign, and Outlook Mail and Calendar features. Must have a working knowledge of a variety of applicable information, including City ordinances, state statutes, and legal descriptions. Must be able to make quick and sound decisions within own scope of responsibility, as established by guidelines and procedures. Must maintain a professional demeanor and demonstrate the utmost integrity in discharging duties of the position.

    Special Requirements

  • Must possess a valid Missouri State Driver's License and be able to provide own vehicle for on-the-job transportation purposes in some cases.
  • Must obtain and maintain certification in the State of Missouri as a Notary Public. Commission is required within first six (6) months of employment.
  • Must be able to obtain and maintain MULES certification, DWITS access, NICHE access, and any other municipal, state, or federal law enforcement database access, as required by the City Attorney and Prosecutor.
  • Miscellaneous Requirements

  • May be required to work a variety of shifts including nights, weekends, or holidays.
  • Subject to emergency call-in.
  • Must be a dependable person due to the small size of the work force.

    Physical Demands

    Performs bending, sorting, kneeling, and reaching to both ground level and overhead as required for such tasks as retrieving files; lifts and carries up to 10 pounds; pushes and pulls up to 25 pounds; must be able to hold and grip objects; may be subject to sitting for long periods of time; ability to operate a computer keyboard and mouse. Some assignments may require the incumbent to hear audiotapes utilized for transcription purposes or record verbal dictation.

    Work Environment

    Primarily indoors with heating and cooling in a general office environment.
