The Vice President, Employment and Litigation will be a key member of the Concentra Legal Team, supporting the Company's labor and employment needs, and managing all litigation for the organization (employment and non-employment). In this role, you will be part of a collegial environment, driving effective employment law processes and practices and serving as a key member of various cross functional teams. The ideal candidate will exhibit a proactive approach to problem solving with an effort to reduce the Company’s risk profile.

 

Reporting to Concentra’s EVP & Chief Legal Counsel, you will partner with members of our Legal, Human Resources, Operations, Risk & Safety, and Executive teams to provide advice, counsel, and support on a broad range of labor and employment law and litigation matters. To be successful in this role, you must have excellent written and verbal communication skills, appropriately balance legal risk with business objectives, drive change, and create effective and relevant presentation and training materials. A practical, business-minded individual would be well-suited for this role.

Responsibilities

Essential Duties & Responsibilities:

  • Provide proactive and strategic counsel on all labor and employment law matters under federal and state laws where we operate, including those related to wage and hour compliance, payroll, benefits, hiring, performance management, internal investigations, leaves of absence, discipline, terminations, and employee classification
  • Represent the company before federal and state government agencies (e.g., the Equal Employment Opportunity Commission (EEOC), Department of Labor (DOL), etc.)
  • Monitor federal, state, and local legislation, regulations, and case law on employment-related matters pertinent to the company; communicate updates and recommendations as needed
  • Assist the Human Resources Team in various initiatives, and developing and implementing policies, procedures, and training to drive compliance with labor and employment laws
  • Provide support for or lead internal investigations
  • Collaborate across the organization to identify, evaluate, and resolve complex business issues and risks
  • Draft, negotiate and update agreements, including arbitration, non-disclosure, restrictive covenants, separation, and settlement agreements as well as independent contractor and vendor agreements
  • Partner with Human Resources and HRIS leaders to ensure best practices for compliance with federal, state, and local labor and employment laws
  • Support mergers, acquisitions, integrations, and new site development
  • Engage outside counsel to analyze material legal and compliance issues
  • Collaborate with Concentra’s Compliance Department as appropriate

 

Litigation Duties:

  • Manage all litigation matters for the company (employment and non-employment), including hiring and overseeing outside counsel, developing litigation strategies, reviewing all pleadings and other filings, and managing litigation budgets
  • Maintain status reports on pre-litigation and litigation matters
  • Lead monthly meetings with Legal, Finance and Executive team members to review open litigation matters
  • Manage all aspects of dispute resolution and pre-litigation investigations, including assessing federal and state agency charges and attorney demand letters, and develop strategies to resolve them
  • Draft responses and position statements, respond to information requests, and participate in fact-finding conferences and mediations
  • Manage one or more legal assistants
  • Assist in the preparation of 10-Q, 10-K and other public company filings
  • Work closely with the Risk Management team
  • Occasional travel required, including periodic travel to Dallas, Texas for those working remotely

Qualifications

  • Doctorate Degree with Major in law
  • J.D. from ABA accredited law school
  • Member in good standing of the Texas Bar or another bar association, with the ability to work inhouse in Texas
  • Customarily has at least seven (7) years or more of related labor and employment law and general litigation experience
  • Must have law firm and in house experience
  • Health care experience preferred (particularly in a multi-state, distributed delivery model)
  • Experience in a fast-paced and dynamic organization preferred
