Cotton Law is seeking an experienced Real Estate Litigation Attorney to join our team as Of Counsel to handle an urgent foreclosure defense matter involving a multifamily property in the Northern District of Texas. This position requires immediate availability and active bar membership in good standing.
You must appear for calendar calls but all other work is remote.
Position Overview
As Of Counsel, you will take primary responsibility for defending a client against a $1,050,000 foreclosure action initiated by Fannie Mae through Reed Smith LLP. The property at issue is located in Tom Green County, Texas, with a foreclosure sale currently scheduled for April 1, 2025.
Qualifications Required
- Juris Doctor degree from an accredited law school
- Active attorney license in good standing with the State Bar of Texas
- Active admission to practice in the Northern District of Texas Federal Court
- Minimum 3-5 years of experience in foreclosure litigation, preferably with experience in:
* Multifamily property foreclosure defense
* Commercial real estate litigation
* Federal court litigation practice
* Experience with non-judicial foreclosures in Texas
Compensation & Terms
- Compensation structure: 45% of billings generated
- Hourly billing rates range from $350-$850 based on complexity
- Travel benefits available (per diem, flight costs, lodging) with prior approval
- 1-year renewable term agreement with opportunity for extension
- Position structured as independent contractor Of Counsel relationship
Immediate Responsibilities
- Review and analyze loan documents, including Deed of Trust, Note, and Security Agreements
- Develop defense strategy against foreclosure proceedings
- Draft and file necessary pleadings in the Northern District of Texas
- Represent client at all hearings and proceedings
- Communicate regularly with client regarding case status and strategy
