ABOUT THE POSITION


The incumbent supervises staff in the performance of various duties related to conservatorship and guardianships in accordance with established laws, regulations, policies and procedures. The incumbent has broad responsibility for managing the daily operations of the office and may participate in casework activities, particularly those cases that are especially complex or difficult.


ABOUT THE DEPARTMENT


The Shasta County Health and Human Services Agency (HHSA) partners with the community to protect and improve the health and wellbeing of Shasta County residents. HHSA is organized into four branches: Behavioral Health & Social Services, Public Health, Economic Mobility, and a centralized Administration Services. HHSA promotes optimal health for all. The frail, the abused, the mentally ill, and those without resources look to HHSA for services and resources to meet their basic needs, and to protect their health and safety.


The Behavioral Health & Social Services Branch is dedicated to improving the well-being of our community through comprehensive mental health services and essential social services to adults, children, and families. By integrating both behavioral health and social support services, we strive to build a healthier community by ensuring individuals have the resources they need to achieve stability and wholeness.

Adult Services focuses on services to support people eighteen and older. Adult mental health services include outpatient mental health care, 24-hour crisis stabilization services for people at risk of hospitalization, 24-hour crisis line, social rehabilitation residential services, long-term placement services and referrals to local non-profit organizations that provide additional services. This branch also provides Adult Protective Services to follow-up on elder abuse reports. In-Home Supportive Services help those who need assistance with daily activities in order to remain safely in their own homes, and the Public Authority keeps a registry that helps In-Home Supportive Services recipients find a screened caregiver to provide those services. The Public Guardian helps citizens who are unable to manage their personal and financial affairs and may require guardianship or conservatorship. Mental Health Services Act administration is also housed in the Adult Services Branch.


DISTINGUISHING CHARACTERISTICS


The incumbent in this class is responsible to the Public Guardian/Program Manager Adult Services for supervising the overall operations of the Public Guardian division of the Social Services agency.


IDEAL CANDIDATE


  • Understand, interpret and apply complex laws and regulations, including the Probate Code, the Lanterman-Petris-Short Act, and the Welfare and Institutions Code 
  • Establish and maintain accurate financial and casework records; analyze and evaluate legal and medical information; draw logical conclusions and make appropriate decisions 
  • Familiar with Probate Code, Local Court Rules, and Welfare and Institutions Code, and applicable laws and regulations relating to conservatorships. 
  • Familiar with rules and regulations governing eligibility and operation of financial and asset management including personal property, real property, and financial investments. 
  • Knowledgeable about functions and procedures of the court system. 
  • Familiar with principles, policies, and procedures associated with the Lanterman-Petris-Short Act. 
  • Knowledgeable about available resources and principles and techniques used in conducting estate and financial investigations to determine conservatees assets, including real property and investments. 
  • Familiar with supervisory principles and practices and skilled in planning, organizing, supervising, and evaluating work of assigned staff. 
  • Skilled in effective communication; experienced in presenting oral and written reports. 
  • Able to maintain effective, cooperative, and understanding work relationships with individuals from a variety of diverse backgrounds, community partners, representatives of the court, financial institutions, and other agencies. 
  • Comfortable providing crisis assistance in sensitive and difficult cases and determining alternate courses of action as necessary. 

Plans, organizes and directs the work of the guardianship/conservatorship staff; assists County Counsel in preparing cases for court in conservatorship hearings or jury trials; assures that all alternatives to public conservatorship have been explored fully; counsels conservatee/relatives as to appropriate resources; carries a caseload of complex Lanterman-Petris-Short Conservatorship cases that deal with serious and persistent mental illness; carries a caseload of probate conservatorships of individuals who are unable, or unwilling, to manage their own estates and who often reside in convalescent homes independently in the community; visits all facilities and conservatees on an ongoing basis and identifies and documents mental, physical and economic abilities and limitations that affect capacity for independent living; makes home visits, evaluates and documents need and makes referrals to other agencies for services that may be a resource to maintain independent living; attends mental health staffings to ascertain potential Lanterman-Petris-Short Conservatorships and provides input as appropriate; advises staff in the provision of personal and financial services for conservatees and represents them with attorneys, creditors, banks and other business entities or interested parties; meets and confers with the Public Guardian/Program Manager Adult Services to ascertain funding and interfacing of social services programs and income maintenance resources available to conservatees; represents the Public Guardian/Conservator at meetings, conferences and staffings; evaluates performance of subordinate personnel and takes or recommends appropriate action; assists and participates in development of training programs; provides data for the completion of fiscal reports as required; reviews and becomes familiar with all changes to pertinent laws and regulations.

Any combination of education and experience sufficient to directly demonstrate possession and application of the following:


Knowledge of: Lanterman-Petris-Short Conservatorship laws and other Welfare and Institution Codes as well as Probate Codes as they apply to conservatorships; community resources available for referral or utilization in social services programs; counseling techniques; basic principles of individual and group behavior; principles of interviewing and problem-solving; local economic resources; principles of personal finance; principles of supervision and training.


Ability to: Plan, assign and supervise the work of others; analyze situations accurately and adopt effective courses of action; apply effective interpersonal skills; develop and maintain cooperative relationships with other County departments, community organizations and resource agencies; prepare and present clear and concise reports; establish and maintain effective personal relationships with incompetent persons; interpret and apply laws to negotiations concerning conservatorship cases; transact complicated financial and business affairs for conservatees.


Minimum Qualifications


A bachelor’s degree including 30 units in social welfare, social/human services, sociology, or other behavioral science, and two years of experience as a Deputy Public Guardian; OR a bachelor’s degree including 30 units in social welfare, social/human services, sociology, or other behavioral science and three years of experience in a public or private agency dealing with individuals with psychological or social problems or mental illness, or experience in a service agency that provides services primarily to adults. Additional qualifying experience may be substituted for the education requirement on a year-for-year basis.
