Job Description
DCLA’s Legal Unit is involved in all aspects of the agency’s operations, ranging from the negotiation of agreements with major cultural institutions to internal matters such as potential conflicts of interest. Primary legal practice areas include contracts, real estate, intellectual property, nonprofit governance, tax-exempt organizations, labor, and employment. The Legal Unit also monitors legal issues and matters of public policy relevant to the nonprofit sector and the cultural community.
The Associate General Counsel position reports to the General Counsel and will perform a broad scope of duties to support the Legal Unit in all aspects of its practice. Representative tasks and responsibilities include, but are not limited to, the following:
- Drafting, reviewing, and negotiating legal agreements with arts and culture non-profit organizations
- Managing all legal issues and real estate matters for City-funded capital construction and equipment projects for arts and culture non-profits, including drafting and negotiating leases, license agreements, restrictive covenants, and funding agreements, as well as reviewing title and other insurance policies
- Coordinating with other City agencies to address inquiries from arts and culture non-profit organizations
- Assisting with agency responses to requests under Freedom of Information Law (FOIL)
- Tracking relevant legislation from Federal, State, and Local legislative affairs
- Performing legal, legislative, and policy research
- Drafting internal agency policies
- Drafting, reviewing, and negotiating consultant/artist agreements
- Advising agency staff and external parties on complex intellectual property questions concerning artistic rights for partnerships between the City and various artists
- Guiding agency staff through legal questions regarding the City’s Conflicts of Interest Laws
- Providing the agency with legal advice concerning labor and employment issues
- Creating, updating, and maintaining legal files, and assisting with records retention schedules
- Conducting training on key legal policies for agency staff
- Coordinating with the New York City Law Department concerning any litigation matters involving the agency
- Assisting with the recruitment and supervision of Legal Unit interns
Preferred Skills:
At least 10 years of work experience in a government/public interest, in-house, or law firm environment is preferred, with a deep commitment to the arts and serving New York City’s nonprofit cultural community. Transactional experience in contract drafting, negotiation, and real estate is preferred, particularly working for City government and/or nonprofit clients. Candidate must be able to communicate effectively both verbally and in writing. Must be able to successfully manage multiple priorities, work productively under pressure, both independently and as a team member, and possess tact and good judgment in confidential situations; must possess a strong attention to detail and organization. Strong computer skills and proficiency with the Microsoft 365 suite.

AGENCY ATTORNEY - 30087
Minimum Qualifications
1. Admission to the New York State Bar; and either "2" or "3" below.
2. One year of satisfactory United States legal experience subsequent to admission to any state bar; or
3. Six months of satisfactory service as an Agency Attorney Interne (30086).
Incumbents must remain Members of the New York State Bar in good standing for the duration of this employment.
In addition to meeting the minimum Qualification Requirements:
To be assigned to Assignment Level (AL) II, candidates must have one year of experience at Assignment Level I or two years of comparable legal experience subsequent to admission to the bar, in the areas of law related to the assignment. To be assigned to AL III candidates must have two years of experience in Assignment Levels I and/or II or three years of comparable legal experience subsequent to admission to the bar, in the areas of law related to the assignment.
Residency Requirement
New York City residency is generally required within 90 days of appointment. However, City Employees in certain titles who have worked for the City for 2 continuous years may also be eligible to reside in Nassau, Suffolk, Putnam, Westchester, Rockland, or Orange County.
