The Employee Relations Specialist (Investigator) is responsible for investigating potential workplace concerns, including violations of company policies, values, and applicable laws and regulations. This role collaborates with site business leaders, HR Managers, and Generalists to ensure fairness and compliance with company policies and local, state, and federal regulations when addressing employee concerns and complaints.
Essential Functions:
- Partner with leaders to support site, departmental, and corporate goals
- Conduct thorough, detailed, and timely investigations into allegations of breaches of the company's policies or laws to ensure fair treatment of all employees
- Initiate and complete all investigation steps, including document review, interviews, investigation reports, recommend remedial actions, and reporting on investigation findings, trends, and related metrics
- Lead and work with third-party resources, such as digital forensics, investigation, and document review firms
- Run document reviews, including the collection, review, and analysis of relevant documents
- Conduct employee training on the company’s investigation process, including reporting channels and the importance of raising issues
- Partner with HR and Training Department points of contact on various types of employment law and/or employee compliance training presentations
- Support HR and Corporate Legal Counsel on other projects, initiatives, discovery requests, and strategic opportunities as may arise from time to time
- Collect and analyze data to identify trends and make recommendations on mitigation strategies
- Advise and train HR generalists and business partners on investigation best practices
- Discreetly lead investigations and manage sensitive and/or private information and sensitive data requests
- Ensure that field operations HR functions are conducted in a collaborative manner
- Other duties as assigned
Knowledge and Skills:
- Advanced proficiency with Microsoft Office Suite in addition to HRIS-related computer programs and software; experience with ADP Workforce Now or UKG preferred
- Must be able to read, speak, and write English
- Knowledge of legal discovery-type software (e.g., Relativity, etc.), or case management or case-tracking software
- Knowledge and application of U.S. employment laws and regulations
- Ability to interpret federal and state employment laws and requirements
- Ability to write investigative reports in a clear and concise manner
- Expertise in analyzing, organizing, and preserving evidence
- Demonstrated ability to identify trends and collaborate with assigned HR Generalists and business partners to resolve matters expediently and thoroughly
- Ability to train HR colleagues and field operations personnel
- Ability to balance multiple sophisticated investigations concurrently
- Emotional intelligence for those involved in the investigation process
- Ability to confront those involved in the investigation process about difficult information and findings
- Self-motivated and persistent; strong ability and comfort in exercising independent judgment for acquiring results while containing legal risk
- Ability to work independently and collaboratively in a team environment
- Ability to work flexible hours in a 24/7/365 business environment
Education and Experience:
- Bachelor’s degree in employee relations, human resources, business management, or related field. Master’s degree in an investigations-related field, preferred
- Professional in Human Resources (PHR or SHRM-CP) certification, preferred
- Five plus years professional experience conducting internal workplace investigations as part of an in-house company organization, governmental agency, compliance entity, or law firm
- Experience conducting corporate investigative fieldwork, including complainant, witness, and subject employee interviews, investigative data analysis, and production of investigative documentation for court submissions
- Experience with a wide range of Human Resources subject areas, such as harassment, discrimination, fraud, misuse of position, etc.
- Experience with employee relations in a skilled trade-based environment
- Experience testifying before administrative bodies or in courts
- Organizational experience in government contracting is preferred
- Experience with Collective Bargaining Agreements and Service Contract Act (SCA), highly desirable
- Bilingual in English and Spanish is preferred
- Must be authorized to work in the U.S. and able to travel within the Continental United States (CONUS)
- Must pass a drug test, motor vehicle record check, and background check after accepting a conditional offer of employment
