In-House Counsel: Experienced employment litigator may also transition to in-house roles, advising companies directly on labor and employment matters and managing disputes without going through external law firms.

Key Responsibilities:

  • Client Consultation:
  • Meet with clients (either employers or employees) to understand their legal issues.
  • Offer legal advice about their rights, options, and possible outcomes.
  • Conduct initial assessments to determine whether legal action should be pursued.
  • Case Preparation:
  • Gather and review all relevant documents, such as employment contracts, employee handbooks, pay records, emails, and other communications.
  • Interview witnesses and collect evidence to support the client’s case.
  • Conduct legal research on relevant employment laws, statutes, and precedents.
  • Legal Representation:
  • Represent clients in administrative hearings, mediations, and court trials.
  • Draft legal documents such as complaints, answers, motions, and discovery requests.
  • Advocate for clients in arbitration or mediation sessions when necessary to resolve disputes without going to trial.
  • Settlement Negotiations:
  • Work to resolve cases through negotiation or settlement, potentially avoiding trial.
  • Communicate with opposing counsel to explore settlement options and reach an agreement that benefits the client.
  • Negotiate severance packages or employment contracts in cases involving disputes over terms of employment.
  • Court Appearances and Litigation:
  • If the case goes to trial, present arguments in front of a judge or jury.
  • Cross-examine witnesses, present evidence, and make closing arguments in court.
  • File post-trial motions or appeals if the case outcome is unfavorable for the client.
  • Compliance and Risk Management:
  • Advise employers on how to comply with federal, state, and local employment laws, reducing the risk of litigation.
  • Provide training on legal issues such as harassment, discrimination, and wrongful termination to help prevent future legal issues.
  • Draft or review employment policies and contracts to ensure compliance with the law.
  • Document Drafting and Review:
  • Review, draft, and negotiate employment contracts, non-compete agreements, and confidentiality agreements.
  • Advise clients on structuring severance packages and settlements in compliance with employment laws.

Skills and Qualifications:

  • Educational Requirements:
  • Juris Doctor (J.D.) degree from an accredited law school.
  • Admission to the state bar in the relevant jurisdiction.
  • Knowledge of Employment Law:
  • In-depth understanding of federal and state employment laws, such as the Fair Labor Standards Act (FLSA), Title VII of the Civil Rights Act, the Americans with Disabilities Act (ADA), Family and Medical Leave Act (FMLA), and other labor-related statutes.
  • Familiarity with employment contracts, workplace regulations, and dispute resolution mechanisms.
  • Litigation Skills:
  • Experience in handling litigation from inception to resolution, including trial experience.
  • Strong oral and written advocacy skills.
  • Ability to analyze complex legal issues and apply legal principles to facts.
  • Negotiation and Settlement Skills:
  • Strong negotiation skills to resolve disputes and avoid lengthy litigation when possible.
  • Experience handling settlement negotiations and mediations.
  • Research and Analytical Abilities:
  • Proficiency in legal research, including using legal databases such as Westlaw or LexisNexis.
  • Ability to analyze cases, statutes, and regulations to identify key issues and strategies.
  • Communication and Client Management:
  • Excellent communication skills to explain complex legal concepts to clients.
  • Ability to maintain strong professional relationships with clients and other legal professionals.
  • Attention to Detail:
  • Strong organizational skills and attention to detail for managing case files, deadlines, and extensive documentation.

Work Environment:

  • Firm or Corporate Setting: Employment litigation attorneys typically work for law firms that specialize in employment law, or they may be employed in-house by corporations or government agencies with legal departments.
  • Hours: Litigation attorneys often work long hours, especially when preparing for a trial. Deadlines, court appearances, and client meetings may require extended hours beyond the typical workday.
  • Travel: Travel may be required for client meetings, court appearances, or depositions, particularly if the client is located in a different jurisdiction.
