Overview: The Financial Industry Regulatory Authority (FINRA) seeks a highly experienced Senior Appellate Counsel to join its Enforcement department. This critical role will play a key part in executing the national appellate program and ensuring the efficient, timely, and effective execution of all appeals.
Responsibilities:
- Represent FINRA in appeals before the National Adjudicatory Council by briefing or arguing appeals
- Coach other Enforcement attorneys on briefing and arguing appeals
- Conduct research and prepare appellate briefs that require minimal editing; review and edit appellate briefs drafted by other Enforcement attorneys
- Collaborate with senior leadership and attorneys across the department to discuss assignments and ensure the efficient, timely, and effective execution of all appeals
- Coach and advise attorneys across Enforcement on the appellate process and forum, brief writing, and oral advocacy
- Conduct moots to ensure attorneys are fully prepared for oral argument
- Review all hearing panel decisions and advise senior management on whether or not to appeal
- Develop policies and procedures regarding appeals
- Determine the need to revise litigation practices as a result of important appellate decisions
- Train litigation attorneys on revised litigation practices
- Recommend training on briefing and arguing appeals and creating a strong hearing record
- Communicate important findings or sanctions in NAC decisions to Enforcement executive management and department-wide staff
Requirements:
- A law degree and licensure to practice law in all applicable jurisdictions
- A minimum of 10 years of experience handling all phases of appeals
- Superior knowledge of trial techniques, federal securities laws, Federal Rules of Evidence, and Federal Rules of Civil Procedure
- Excellent research, writing, analytical, organizational, and time management skills
- Excellent interpersonal, written, and oral communications skills
Working Conditions:
Work outside of business hours and some overnight travel may be required.
Location: Multiple locations, including Washington, D.C., Jersey City, New Jersey, Denver, Colorado, and others. Compensation is based on factors including but not limited to, skill set, level of experience, education, and internal peer compensation comparisons.
