Key Responsibilities
- Assess intricate trust and estate planning issues to devise effective strategies for clients.
- Draft sophisticated estate and gift tax planning frameworks, encompassing various corporate dealings and trusts, including ILITs, SLATS, and charitable lead annuity trusts.
- Oversee the preparation and submission of tax documents, such as Federal Form 706 and Form 709, ensuring compliance and accuracy.
- Offer expert counsel on trust and estate planning documentation, trustee responsibilities, beneficiary rights, and tax implications of distributions.
- Manage individual and family trusts, supervising investments, banking activities, real estate portfolios, and ensuring adherence to tax regulations.
- Prepare trust and fiduciary accountings for Attorney-Trustees, managing financial records, income, disbursements, and delivering accountings to beneficiaries.
- Review and authorize foundational estate plans prior to client submission.
- Draft comprehensive estate and gift tax planning structures and corporate transactions, including preferred partnership freezes, Family Limited Partnerships, and tax-free reorganizations.
- Coordinate the preparation and filing of Federal Form 706 for Estate and Generation-Skipping Taxes, liaising with clients and service providers to gather necessary documentation and prepare extensions as required.
- Prepare and file Form 709 for United States Gift Taxes for transfers to individual donees, ensuring proper tax treatment concerning cost basis, lifetime gifting exemptions, and split-gifts.
- Examine trust and estate planning documents, advising clients on trustees’ authorities and duties, dispositive provisions, beneficiary rights, and the tax treatment of distributions.
- Administer family and individual trusts, ensuring compliance with federal tax regulations.
- Generate trust and fiduciary accountings for Attorney-Trustees, managing incoming financial statements, identifying income and disbursements, and delivering accountings to trust beneficiaries.
- Active member of The Florida Bar.
- Demonstrated expertise in Estate Planning, Asset Protection, and Trust Administration.
- Quick comprehension of new legal principles in a rapidly evolving landscape.
- Proficient in drafting software such as WealthDocs and client management tools like Clio.
- Bilingual proficiency in English and Spanish.
- Juris Doctor (JD) from an accredited law school.
- Minimum of 3 years of relevant experience in Estate Planning and Trust Administration.
- Proven experience in client interaction and managing complex estate matters.
