GENERAL STATEMENT OF DUTIES

This position is responsible for the analytics, compliance, and reporting that will improve the County’s MWBE services, positively impact decision making and promote community engagement for the program. This position reports to the MWBE Deputy Director.

DISTINGUISHING FEATURES OF THIS CLASS

This position is responsible for MWBE compliance, data analytics, and reporting. The position works collaboratively with departments to manage, oversee, and administer contract diversity and inclusion participation, contract development and negotiation, compliance reviews and development of performance and risk mitigation strategies in support of all diversity and inclusion procurement needs and requirements. The MWBE Compliance and Data Officer assists with the implementation of policies, procedures, and standard forms for the MWBE program and Historically Underutilized Business (HUB) program; assists the director with review of data and trends and makes recommendations for growth and development of the program; audits and monitors projects and contracts in progress to ensure MWBE compliance. Work involves the exercise of initiative functioning with a high degree of independence, ability to review, gather, and analyze data and make sound business decisions. Work requires considerable public contact with program clientele, employees, other departments or the public in explaining policies and procedures. Employee participates in the preparation of the MWBE reports through review and analysis of complex and sensitive departmental/program requests and the presentation of recommendations. The MWBE Compliance and Data Officer assists departments in preparing reports, gives advice on management issues and reviews contracts for compliance with established MWBE policies and procedures. An employee in this position oversees and coordinates more complex county-wide initiatives and projects including performance measurement and management, program and service evaluation.

Work may require evening and weekend work assignments for some compliance, outreach and training activity. Work is performed under the general supervision of the MWBE Program Director and Deputy Director. This is a professional non-supervisory classification.

Duties And Responsibilities

Essential duties and responsibilities include, but are not limited to:

  • Oversees the development, implementation, and administration of the County’s contracting and payment compliance program.
  • Transform data into actionable information that can be used to meet strategic goals and solve challenging problems.
  • Coordinates assigned processes and programs such as multi-year planning processes, and components of compliance initiatives.
  • Apply a broad range of analytic techniques and approaches to support collaborative problem-solving across the organization – e.g., data visualization, statistical analysis, business process modeling.
  • Develops methods to identify barriers in meeting MWBE goals, recommends corrective actions and assists in the overall achievement of MWBE initiatives.
  • Assist with analyzing countywide contract and payment data to produce an annual MWBE report.
  • Evaluates MWBE compliance processes and procedures to determine efficiency and effectiveness and to assess the achievement of established goals and objectives.
  • Develop and review of benchmarking, performance measures and strategic planning
  • Assists in the review of procurement contracts to ensure maximum MWBE utilization to achieve MWBE goals.
  • Investigates and resolves alleged MWBE compliance violations.
  • Conducts compliance reviews of county departments procurement activities, contractor and subcontractor utilization, including performing site visits to ensure adherence to contract terms and conditions.
  • Assists and coordinates as needed the work of other compliance officers and employees in the completion of assigned duties and tasks
  • Reviews and reports the County’s MWBE utilization data to determine the growth and progress of MWBE businesses and provides monthly updates to the MWBE Director.
  • Assists in the maintenance, operation, and troubleshooting of compliance software.
  • Reviews and assesses new and pending legislative changes and their resulting fiscal and programmatic impact on county departments and services.
  • Performs related work as required or as delegated by supervisor.

RECRUITMENT STANDARDS

Knowledge, Skills, And Abilities

  • Experience with implementing and administering an organizational wide contracting compliance system. Knowledge of SkillSmart or another industry recognized compliance system is preferred.
  • Knowledge and strong experience in public procurement systems and processes.
  • Experience with Power BI or similar platforms to perform tasks such as reporting, building dashboards, and analyzing datasets.
  • A proven track record of developing processes and procedures and implementation across the organization.
  • Knowledge and experience in procurement/contracting laws and regulations including knowledge of NC General Statutes and guidelines for federal, state and local funding and related regulations regarding minority participation in contract awards.
  • Ability to establish and maintain effective working relationships with MWBE businesses, strategic internal & external partners and stakeholders as necessitated by work assignments. Acts as the primary liaison with the County’s departments to ensure compliance with MWBE procedures and policies.
  • Ability to analyze data and information and draw logical and objective conclusions, perform investigations, interpret and apply laws and regulations, policy and procedures.
  • Proven ability to meet tight deadlines, multi-task, and prioritize workload.
  • Working knowledge of mathematical computations, analytical skills, government accounting theories, principles and methods and evaluation/research techniques and methodology.
  • Ability to effectively express ideas on technical subjects clearly and concisely orally and in writing.
  • Ability to exercise independent and sound judgment, discretion, initiative, creativity, and resourcefulness.

Typical Qualifications

MINIMUM QUALIFICATIONS

Graduation from an accredited college or university with major course work in Business Administration, Public Administration, Urban Planning, Finance, Accounting, Engineering, Construction or related field and 3-5 years of considerable and progressively responsible work experience with diversity programs, MWBE or procurement.

Experience in a governmental setting is preferable.

Physical Demands and Work Conditions

Work is sedentary. Typically, the employee may sit comfortably to do the work. However, there may be some walking, standing, bending, carrying of light items such as papers, books, small parts, driving and automobile, outside work for site visitation, or use of a PC to accomplish work objectives. No specific physical demands required. Mental demands and normal stress regarding achieving work deadlines are present.

May Require Driving

This position may require driving for this position whether driving a County owned or personal vehicle to conduct county business such as but not limited to attending conferences, meetings, or any other county related functions. Motor Vehicle Reports may be verified for valid driver’s license and that the driving record is compatible with the county’s driving criteria.

If a personal vehicle is operated for county business proper insurance is maintained as per Guilford County’s vehicle use policy.
