The Legal Services & Risk Director serves as a pivotal liaison for all Herc departments, providing expertise in lien laws, noticing, and bond claims while overseeing the company's third-party collection agency and attorney placement processes. This role also oversees the Credit Department, managing customer onboarding, credit limits/extensions, account suspensions, and creditworthiness evaluations. Collaborating with leadership, the Legal Services & Risk Director develops efficient systems and procedures to meet departmental goal and driving revenue growth while minimizing bad debt. - Ensure functions are done in accordance with policies and procedures
- Perform quality and quantity audits of the lien processing function
- Evaluate department employees and address any issues that may arise
- Perform review of accounts sent by Herc Collection Staff, Region Liaisons and Field Staff to ensure their Preliminary Notice or Lien Release request is processed within the Department Guidelines
- Review of lien rights that have been filed and explanation for exceptions are documented
- Utilize all available tools/resources to conduct thorough risk assessments to generate revenue and increase market share while minimizing risk
- Provide day-to-day guidance and support internal/external business partners
- Ensure credit limits are set appropriately based on creditworthiness to maximize revenue and minimize risk
- Responsible for providing monthly reporting and stats to Senior Management
- Collaborate with Accounts Receivable, Operations, and Corporate Security to prevent account fraud and resolve property damage claims
- Annual review for compliance is conducted as requested with internal and external audit
- Source of advice for the field on legal issues with equipment such as personal injury, writ of replevin, cases of theft and/or conversion, etc.
- Participate in litigation theory with outside counsel

- Review all functions/systems to ensure a cost-effective use of resources and identify/eliminate non-value-added functions
- Provide and articulate Bad-Debt Reporting such as Bad Debt Write-offs, Placement and Recovery and other calculations
- Coordinate Lien and Bond Claims with appropriate Internal / External Business Partners and external collection agencies or attorney network
- Receivables reporting analysis to enable rapid, fact-based decision-making and economic thinking
- Manage accounts, re-activations and referrals to Third-Partly Collectors and Attorneys
- Manage the process for accounts placed with Third-Party Collections and external attorney network
- Maintain relationships with Internal and External Business Partners to drive efficiencies in processes
- Assist in projects, process improvements, and other collection-related tasks as identified by management
- 5-10 years of leadership experience
- Recent work experience in commercial credit review, risk assessment, and liens/bonds preferred.
- A paralegal certificate or law license is a plus.
- Construction/Mechanic lien experience
- Legal/Paralegal experience in the construction industry preferred
- Decision Making/Analytical Skills
- Proficient in Microsoft Excel and Word
- Detailed and Deadline Oriented
- Ability to handle multiple projects and shifting priorities
- Excellent communication and organizational skills
- Strong Leadership and People skills

Pay Range: $145,000 - $175,000
