What are the responsibilities and job description for the Claims Counsel position at Heritage Insurance?
Job Summary:
Reviews anticipated litigation related to the organization and ensures maximum protection of the organization's legal rights. Provides legal advice and training to claims personnel. Must be a graduate of an accredited law school with at least 1 year of experience in Property and Casualty Claims as Litigation Counsel and be admitted into and currently licensed to practice law in a state bar.
Demonstrates expertise in a variety of the field's concepts, practices, and procedures. Relies on extensive experience and judgment to plan and accomplish goals. Performs a variety of tasks. A wide degree of creativity and latitude is expected. Reports to Senior Claims Counsel.
Essential Duties and Responsibilities:
- Stays current with key changes in the legal and regulatory environment and relays to claims personnel
- Conducts analysis of claim investigations and gives recommendations regarding legal and regulatory implications
- Responds to State Department inquiries promptly
- Responds to subpoenas for records
- Conducts claim Examinations Under Oath
- Attends hearings/depositions as needed
- Ensures that insurance coverage positions are consistent with our policy language and contracts
- Collaborates frequently within the Claims Counsel team to ensure a harmonious alliance in its communication of objectives, goals, and opinions
- Mentors claim professional(s), with frequent in-person collaboration, and assistance with legal interpretation and application of statutes and case law
- Develops and conducts in-person trainings as indicated by Senior Claims Counsel and VP of Claims, in collaboration with claims support departments
- Assists in the upkeep of communications templates as needed
- Communicates with co-workers, management, clients, vendors, and others as needed in a helpful, courteous and professional manner
- Maintains the integrity of the company and products offered by complying with federal and state regulations as well as company policies and procedures
- May perform other duties and responsibilities as assigned
Job Qualifications:
- Law Degree
- Current good standing with a state Bar
- 1 years of multi state or Florida property & liability (complex, litigated cases) experience with law firm, insurance carrier, third party administrator or insurance broker
- Strong analytical skills related to investigations, claims strategies and claims reviews
- Previous experience demonstrating strong written and verbal communications skills; ability to handle difficult situations
- Strong attention to detail, including regular follow up on action items
- Knowledge of property and casualty law, case law,civil procedure, claims processes, legal proceedings
- Intermediate technology skills related to Excel, queries, and insurance company risk management information systems
- Ability to work in fast paced team environment, handling multiple tasks and meeting deadlines
- Ability to work in office, and travel occasionally
