TITLE : ASSOCIATE ATTORNEY - BANKRUPTCY JOB CODE : FULL-TIME / EXEMPT / SALARY
DEPARTMENT : BANKRUPTCY LEVEL : ATTORNEY
REPORTS TO : SHAREHOLDER / MANAGING ATTORNEY
PRIMARY RESPONSIBILITY :
This is a transactional attorney position with a practice focused on representing mortgage servicers and investors in residential and commercial real estate bankruptcy matters. The attorney in this position will draft and file documents such as proofs of claim, objections to confirmation, and motions for relief from the automatic stay. Additionally, this attorney will review bankruptcy plans, prepare payment change notices, prepare notices of post-petition fees, expenses and charges, and respond to notices of final cure. The attorney will communicate daily with clients, debtors, and attorneys. Hearing attendance may be required. This position is in-office.
PRIMARY ACCOUNTABILITIES :
1. Review client referrals and documentation;
2. Draft requisite documentation utilized in bankruptcy matters;
3. Review work product of staff (comprised of legal assistants and processors) for accuracy;
4. Communicate with clients through a combination of phone, email and client database systems;
5. Maintain a current knowledge of any trends, regulations or legislation affecting the assigned area of practice;
6. Settle cases and attend hearings;
7. Perform additional duties as requested.
SKILLS / EXPERIENCE :
1. Juris Doctorate;
2. Preferred - Two (2) to Four (4) years of bankruptcy experience;
3. Preferred - Licensed to practice law in the State of Arkansas;
4. Preferred - Licensed to practice law in the State of Tennessee;
5. Strong analytical skills with attention to detail;
6. Excellent oral and written communication skills;
7. Excellent organizational, planning and prioritization skills;
8. Ability to work through complex real estate matters;
9. Must be PC literate and able to rapidly adapt to a variety of data base systems;
10. Ability to represent the company in various forums to foster the desires and image of the company in the community.
