Associate General Counsel (Construction Procurement)

Location: Sweetwater County, Wyoming

Type: Direct Hire

Our client in Sweetwater County Wyoming is initiating a multi-billion-dollar capital project set to redefine trona mining and soda ash processing. They are seeking an Associate General Counsel (Construction Procurement) to provide strategic legal guidance and oversee all aspects of construction procurement and contract management.

Position Overview

The successful candidate will serve as a primary legal advisor, managing a wide range of legal responsibilities across the entire lifecycle of large-scale capital procurements. This includes the development of sophisticated construction agreements, navigating complex regulatory frameworks, and mitigating risk through proactive legal strategies.

Key Responsibilities

  • Contract Drafting and Negotiation
  • Develop, negotiate, and manage comprehensive construction and procurement contracts, including agreements for alternative delivery methods such as progressive design-build, construction manager-at-risk (CMAR), and delivery partner models.
  • Ensure that all contract terms are favorable and legally compliant while addressing risk mitigation, performance guarantees, and project delivery milestones.
  • Procurement and Bid Management
  • Provide expert legal advice during the procurement process, from RFI through RFQ and RFP phases, managing bidder questions, bid evaluations, and contract awards.
  • Oversee and guide procurement documentation, ensuring clarity and adherence to legal standards.
  • Claims Resolution and Dispute Management
  • Act as the primary legal advisor for managing and resolving construction claims, including contract disputes, delay claims, and cost escalation issues.
  • Lead mediation, arbitration, or litigation processes as required, with a focus on achieving favorable outcomes for the firm.
  • Risk Management and Compliance
  • Identify, analyze, and mitigate legal risks related to construction and procurement activities.
  • Ensure compliance with federal, state, and local laws, including environmental regulations, labor laws, and industry standards.
  • Strategic Counsel and Advisory
  • Advise project teams on legal strategies, emphasizing proactive risk management, cost containment, and effective dispute resolution.
  • Stay up to date with evolving laws and industry best practices to continuously improve the project’s legal framework.

Qualifications

  • Education: Juris Doctor (JD) degree from an accredited law school.
  • Bar Membership: Active membership in good standing with a state bar (preference for Wyoming or eligibility for admission).
  • Experience:
  • Minimum of 8 years of experience in construction law, with a proven track record of managing procurement and large-scale infrastructure or capital projects.
  • Expertise in drafting and negotiating construction contracts, including familiarity with alternative delivery methods.
  • Strong background in dispute resolution, including mediation and arbitration.
  • Familiarity with regulatory compliance and risk management practices.
