Position Description: Land Use Administrator
Division: Legal — Land Department
Reports to: Land Director
Worksite: Land Department Office, Cass Lake
Work Hours: M-F, 8:00am — 4:30pm
LLBO Status: Exempt
Safety Sensitive: No
License/Certification Requirements: Must have a valid MN driver's license, current insurance or be insurable.
Summary: Responsible various functions in the Leech Lake Band of Ojibwe's Land Department as it relates to surface and subsurface leasing, permitting and rights-of-way, land acquisition and disposal, trust estates, planning and implementation of land use ordinances; in order to maxze utilization of lands, generate revenue, assure al] land transactions are advantageous to the Indian landowner and promote trust land consolidation activities.
Education Requirements and Experience:
Bachelor's Degree in Business or two years' professional experience in land related field.
Additional Qualifications and Skills:
Knowledge of Federal Indian real estate laws and regulations and Tribal real estate policies, procedures pertaining to acquisition and disposal, leases, permits and right of-way on tribal and allotted lands.
Thorough knowledge of and ability to: interpret and prepare land descriptions and conveyance documents, leases, rights-of-way, probate orders and wills.
Thorough knowledge of: The Privacy Act and Freedom of information Act as they apply to management, ownership md inheritance of Indian trust land.
Knowledge of laws, rules and regulations of the BIA, MCT and Leech lake Reservation governing use of Indians lands, State Real Estate Law and various county, township and city zoning regulations.
Thorough knowledge of: principles pertaining to urban planning, such as land use concepts and land use impact considerations.
Knowledge of: local demographics, geography and socio-economics considerations.
Considerable ability to establish and maintain relationships with: coworkers, other agencies and the general public.
Ability to; analyze difficult planning programs and to develop a positive course of action.
Ability to; assist in the preparation of comprehensive master plans and to maintain them with accuracy.
Ability to; negotiate complex land development issues.
Skill in the use of: microcomputers and the programs and applications necessary for successful job performance.
Ability to apply established laws, rules and regulations and procedures in preparing conveyance instructs for Acquisition, disposal or use of Indian lands (both fee and Trust).
Excellent communication skills both: verbally and written.
Team work attitude required.
Pre-employment drug testing is mandatory for all Leech Lake Band of Ojibwe positions.
Duties/Responsibilities:
Consult and cooperate with the Land Use Committee during its study of the Reservation's land use needs and development of the Official Tribal Land Use Comprehensive Plan and development of the official Tribal Land Use Map.
Provide a monthly report listing all permits applied for and the status of each to the Land Use Committee.
Issue or deny Building Permits according to the provisions of this Ordinance.
Make recommendations to the Land Use Committee or the Tribal Council concerning any matter under appeal. Make recommendations to the Land Use Committee on the effect of a proposed Conditional Use Permit, Subdivision Permit or Variance upon the safety, morals and general welfare of occupants of surrounding lands.
Investigate violations and take enforcement action as necessary according to the provisions of this ordinance. Assure inspections are conducted of buildings and land use of land to determine compliance with the terms of this ordinance.
Maintain permanent and current public records pertaining to this Ordinance, including but not limited to, all maps, all requests for approval or denial of amendments, permits, conditional use, subdivisions variances, and applications.
Receive, file and forward all applications for appeals, variances, conditional uses, subdivisions or other matters to the Land Use Committee.
Provide or obtain such administrative, technical and professional assistance as may be required by the Land Use Committee in the exercise of its duties.
Require the permit applicant to furnish such additional information as may be necessary to properly evaluate and administer the permit.
Provide the appropriate assistance to ensure that the permit application complies with all applicable permit requirements of this Ordinance.
Facilitate communication with County, State, and governmental agencies as appropriate.
Attend and or conduct all mandatory meeting and trainings as required.
Maintain confidentiality and professional ethics at all times.
Travel in and out of the state on a possibly regular basis.
Understanding and sensitivity to Native American culture.
Adhere to policies governing staff conduct.
All other related duties as Assigned
