Responsibilities:
Confers with applicants for copyright registration and recordation, or their representatives, either by phone, in-person, or through written media (such as letters or emails) explaining registration and recordation requirements and regulations. Also, provides information regarding the recordation of Mask Works, Vessel Hull designs, and for the recordation of Online Service Providers. Provides information regarding problems and policy for obtaining certified copies of Copyright records and materials.
Answers diverse and complicated questions on copyright law, and Copyright Office policies and practices in explaining the registration process. Where information is not readily available, consults with staff in other sections/divisions in the Copyright Office or conducts research in formulating an appropriate response. The answers and information given by the incumbent are considered to express the position of the Copyright Office and require comprehensive knowledge and extreme discretion.
Independently responds to letters of inquiry and composes detailed draft replies. Answers copyright claim inquiries for which replies and solutions are well-precedented. Applies a broad knowledge of the law, regulations, and practices in a response to direct inquiry on relevant sections of the law and/or Code of Federal Regulations. Interprets and explains complex correspondence received from the Copyright Office regarding informalities in registering claims and recording documents. When unable to resolve such inquiries, refers the case to the Examining Division.
Performs initial review and processes all applications, deposits, and attachments, including recordation materials submitted through the Public Office, for adequacy and compliance with general legal requirements and formalities, and other factors that relate to the registration of claims and the recordation of materials. Analyzes the nature of filed applications where information contained in the application or deposit is unclear or prevents registration. Makes initial determination whether the legal and formal requirements of the copyright law have been met. Advises applicants when claims may not be registerable.
Performs a variety of tasks in accepting applications and documents, including the resolution of problems with applications or deposits prior to their submission that may delay registration. Assists applicants in completing applications for registration, and in the correction of informalities. May discuss the extent of copyright protection for and the effect of registration on the material submitted.
Works in a limited capacity on lectures through the planning, organization and delivery of presentations to lay audiences outside the Copyright Office interested in the copyright law and the general operation and workflow of the Copyright Office. Conducts special tours within the Copyright Office for visitors, dignitaries, and groups, and participates in public and professional meetings, workshops, and exhibitions, etc., by answering questions and/or representing the Copyright Office.
