Description
The State's Attorney is an appointed position that directs the activities of the State's Attorney's office and is responsible for the prosecution of all criminal and juvenile cases in McKenzie County. This position reports to the Board of County Commissioners until the election in 2026, in which it will return to an elected office. The schedule is Monday-Friday. Level and salary commensurate with experience. This position is not responsible for the civil duties associated with McKenzie County.
Essential Job Functions

- Prosecute and attend the District Court of conduct, on behalf of the State, all prosecutions for public offenses. This includes going through all criminal investigations/cases and determine what may not merit prosecution.
- Advise law enforcement on how to follow various constitutional requirements and protections.
- Act as legal advisor to Mountrail McKenzie Human Service Zone.
- Institute proceedings on behalf of the McKenzie County Human Service Zone. This includes juvenile deprivation, juvenile delinquents, and unruly juveniles.
- Supervise office staff including scheduling, work assignments/special projects, training, counseling, and evaluating.
- Develop and/or implement policies and procedures, forms, work methods, schedules, job priorities to be followed and coordinate all Departmental work.
- Initiate any civil or criminal asset forfeitures on behalf of the county.
- Institute proceedings under chapter 25-03.1 for mental health involuntary commitment proceedings.
