The Legal Counsel and Title IX Director ensures that the college and employees operate ethically, legally, and according to regulations. They oversee internal policies, control and review all legal documents to identify legal and regulatory risks, and implement solutions. This position ensures compliance with all requirements under Title IX, Title VII, various Civil Rights Discrimination Laws, Americans with Disability Act, Section 504 of the Rehabilitation Act of 1973, Violence Against Woman Reauthorization Act of 2013, and laws otherwise designed to assure an equitable education and work environment. They offer guidance to the college on legal matters; conduct internal investigations involving areas of compliance with legal and/or Board policies, Title IX, Non-Discrimination, and Student Conduct issues.

Responsibilities

 

  • Provides legal assistance and guidance in the preparation and review of college policies, procedures and legal documents including contracts and affiliation agreements for legal sufficiency
  • Serves as the College Title IX/Civil Rights Coordinator and Dispute Resolutions Coordinator
  • Oversees the mediation and arbitration process; represents the college or assigns and works with outside counsel to handle legal matters as necessary and appropriate.
  • Ensures compliance with state and federal non-discrimination laws, regulations, and guidelines. Keeps informed of current and developing legislation, regulatory updates, case law; evaluates the potential impact on the College including, but not limited to discrimination and harassment of protected classes/characteristics, including obligations under Title IX/Civil Rights, Title VII, VAWA, and ADA
  • Trained as a Title IX Investigator. Conducts prompt, thorough investigations of Title IX/Civil Rights allegations, as well as general disputes involving college staff, students, or third parties; drafts investigation reports, issues findings, determinations and recommendations. Assists with employee disciplinary actions and/or terminations; ensures compliant record keeping, maintains files, disposition reports, audit trails, and other compiled records
  • Attends workshops and seminars relating to school legal services and provides professional development/training to administrators and staff regarding legal issues, Title IX/Civil Rights including dating violence, domestic violence, sexual assault, and stalking; compliance issues relative to the college
  • Assists with the College’s Annual Security Report and Biennial Review
  • As the Compliance Module Administrator, works with the Clery Compliance Officer and Human Resources to identify, notify and train persons identified as Title IX/Clery Responsible Employees/Campus Security Authorities
  • Responsible for training the Title IX Investigators, Decision-Makers and confirming that members complete annual compliance required trainings
  • Responsible for ensuring required policy/policy statements are distributed to the campus community each semester and for new hires; ensure accurate tracking of policy distribution
  • Oversite and review of college policies and procedures
  • Develops and manages the departmental budget.
  • Serves as the Maxient System Administrator; responsible for maintenance and upgrades to the system and training users as appropriate.
  • Recognized as an ADA Coordinator; provides assistance in this capacity to the Student Accommodations Services; Acts as the alternate member representative for the College in the Michigan Community College Risk Management Authority (MCCRMA).
  • Serve as the college’s Freedom of Information Act (FOIA) Coordinator and ensures timely responses to requests
  • Per the Jeanne Clery Disclosure of Campus Security Policy and Campus Crime Statistics Act (Clery Act),a federal consumer protection law, your job position entails functions that meet the definition of a Campus Security Authority (CSA).  CSAs have a duty to report any crime to the College’s Clery Compliance Officer. This information may be disclosed to them directly, through third-party, or witnessed. As a CSA, you are required to complete annual training which is provided by the College. This training encompasses your role, responsibilities, and reporting obligations

  • Qualifications

    Knowledge, Skills, Abilities:

    • Excellent listening and interpersonal skills
    • Analytical ability to identify and resolve a variety of issues or challenges in an effective and timely manner
    • High proficiency in computer usage, including Microsoft Office, Google Docs/Calendar, and database interaction (student information system)
    • Excellent time management skills
    • Demonstrated effective verbal and written communication skills
    • Ability to work effectively with departments across the College
    • Ability to maintain confidentiality
    • Effective presentation, public speaking, and facilitation skills
    • Project management skills and experience

    Education, Certification, Licensure:

    • Juris Doctorate required

    Experience:

    • Minimum of three (3) years experience in employee relations, conduct or compliance required
    • Proficiency in comprehension of Federal and State laws and regulations mandatory
    • Understanding of Title IX, ADA/Section 504, and VAWA mandatory
    • Knowledge of Michigan State laws mandatory
    • Legal experience preferred
    • Previous experience in a community college setting preferred

    Working Environment:

    • The job responsibilities of this position are performed in an office environment which requires a professional image and demeanor; punctual attendance and reliability. The environment has little, if any discomfort due to heat, cold or dust. There is light noise within the environment
    • There may be occasional travel to other College locations for meetings/duties
    • Job duties may be performed in an independent or a team atmosphere
    • The job has intermittent periods during which continuous physical exertion is required, such as walking, standing, sitting, stooping, bending, climbing, lifting material or equipment, some of which may be heavy or awkward (5- 45 pounds)
    • Must meet reasonable and sometimes shifting deadlines, quotas, or rigorous demands for accuracy; may be involved in some unpleasant situations
    • Typical work schedule: 8:00am – 4:30pm, Monday – Friday.
