Our law firm is a well-established practice specializing in trust and estate litigation, probate law, and related matters. We represent clients in a wide variety of cases, including will contests, trust disputes, real estate litigation, partition actions, and guardianship proceedings. As we continue to expand, we are looking for an experienced litigation attorney to join our team in a hybrid or remote capacity for our Albany, NY office.
Position Overview:
We are seeking a highly skilled and motivated Litigation Attorney with at least 5 years of experience in trust and estate litigation, probate, real estate litigation, and related areas of law. The successful candidate will be licensed to practice in New York State and will be able to represent clients in court both in-person and virtually across Albany County and surrounding counties, as well as other jurisdictions within New York State.
The ideal candidate will possess strong courtroom presence, excellent legal research and writing skills, and the ability to manage cases from initial filing through trial and appeal. The position offers the flexibility to work from home or in a hybrid work environment, with in-person appearances and travel required for court proceedings.
Key Responsibilities:
- Represent clients in trust and estate litigation, including will contests, trust disputes, probate matters, partition actions, and guardianship proceedings (Article 81).
- Manage a caseload from intake to resolution, including preparing and filing legal documents, engaging in discovery, conducting depositions, and appearing at hearings, mediations, and trials.
- Provide strategic advice and legal counsel to clients in the areas of estate administration and litigation.
- Draft legal pleadings, motions, and other documents with a high degree of precision.
- Conduct legal research on complex issues in estate law, trust litigation, and real estate litigation.
- Negotiate settlements and draft settlement agreements in contested estate and trust matters.
- Appear in person or virtually for court hearings and trials across Albany County and surrounding areas, with travel to other jurisdictions in New York State.
- Collaborate with other attorneys, support staff, and clients to ensure effective case management and outcomes.
- Keep clients informed of case developments and provide updates on legal strategies and outcomes.
- Maintain an up-to-date knowledge of applicable laws, rules, and best practices in trust and estate litigation, real estate law, and guardianship proceedings.
Qualifications:
- J.D. from an accredited law school.
- Admission to practice law in New York State.
- A minimum of 5 years of experience in trust and estate litigation, probate, real estate litigation, partition actions, will contests, and Article 81 guardianship proceedings.
- Demonstrated ability to handle complex litigation matters and court appearances.
- Strong legal research, writing, and oral advocacy skills.
- Proven ability to manage a high-volume caseload and meet deadlines.
- Comfortable appearing in court both virtually and in-person across New York State, including travel to other counties as needed.
- Excellent interpersonal skills and the ability to work effectively with clients, opposing counsel, and colleagues.
- Self-motivated, organized, and able to work independently with minimal supervision.
- Ability to work in a remote or hybrid work environment, with flexibility to attend court appearances and meetings as required.
