- In-House Associate Counsel (hourly wage or salary equivalent based on expected hours per week) - $40-$53/hr DOE

Position Overview:
We are seeking a Part-Time Law Clerk or In-House Associate Counsel in collections law (experience preferred but not mandatory). This is an ideal position for a law clerk, or for a licensed attorney as either a stand-alone part-time position or an opportunity to expand your practice. You will gain valuable experience in collection and consumer protection laws and regulations, and corporate compliance, as well as pleading, motion, and trial practice.
Your responsibilities will include reviewing complaints and answers, responding to and filing motions, appearing at pre-trial and other scheduling conferences, negotiating with consumers and/or their counsel (within the context of the legal process), and appearing at trial as needed. You will also have responsibility for company-wide monitoring of and compliance with applicable consumer protection laws and regulations, including the Fair Debt Collection Practices Act (FDCPA), the Fair Credit Reporting Act (FCRA), the Telephone Consumer Protection Act (TCPA), and others.
This position currently contemplates a part-time (20-30 hrs/wk), flexible schedule. Remote work opportunities are available after completing in-office training and a showing of trust and competence. Full-time opportunities may become available with time, growth, and if mutually desired. Candidates must be either a third-year law student or licensed to practice law in the state and federal courts of Utah.
Primary Responsibilities:
- Litigation/Court Procedures and Process
- Review and assess case files in preparation for and prosecution of litigation.
- Represent MLC as counsel of record—which includes reviewing and responding to motions, drafting motions, participating in scheduling and pre-trial conferences (most via Webex), and appearing at trial as needed.
- Negotiate settlement/resolution with consumers/their counsel throughout the legal process.
- Compliance:
- Monitor and stay abreast of ever-evolving collection and consumer protection laws and regulations (federal and state based).
- Monitor and ensure company-wide compliance with all such laws and regulations, including specifically the FDCPA, FCRA, TCPA and others.
- Create/revise written company compliance policies.
- Consumer Complaints and Responses:
- Oversee the process and logistics of handling and responding to formal and informal consumer complaints (court filings, FDCPA, BBB, etc.) in an efficient, timely, and compliant manner.
- Create/revise written company consumer dispute policies
Qualifications:
- Third-year law student -OR- Juris Doctor (JD) from an accredited law school.
- Required - Admitted to Utah State Bar in good standing. Licensed to practice law in state and federal courts of Utah.
- Required - Strong legal writing, negotiation, and communication skills, with a constant emphasis on clarity and professionalism.
- Required - Ability to work independently and manage tasks while collaborating with a team.
- Required - Exceptional attention to detail.
- Required - Initial in office training to assess remote-work competency and trust.
- Weighted - Prior litigation/motion experience.
- Weighted - Prior experience with collections and/or consumer protection issues and laws.
- Weighted - Familiarity with FDCPA, FCRA, TCPA, and other relevant consumer protection laws and regulations, or a demonstrated strong acumen for learning and staying abreast of such.
- Weighted - Prior compliance monitoring experience.
