POSITION DESCRIPTION : This attorney serves as part of the Office of General Counsel statewide leadership team. The primary responsibility for the attorney in this position is to plan, organize, and direct the legal activities of the administrative law practice area of the Department's Office of the General Counsel. This attorney also directly provides legal advice to the Department and legal representation of the Department in major administrative proceedings. The duties associated with these responsibilities include :

Set policies and procedures and assign cases to administrative law attorneys; monitor attorney caseloads and the scheduling of hearings and trial dates; develop, update, and implement procedures for preparation of legal documents and papers utilized in administrative and circuit court proceedings; maintain a filing and document retrieval system for the prompt and efficient record management of all administrative filings; supervise and review the preparation of legal documents by administrative law attorneys; supervise staff engaged in the preparation and typing of legal documents, correspondence, and travel itineraries and reimbursements, handling telephone calls and visitors, making travel arrangements, maintaining case files, and ensuring case files are properly closed and archived for ease in future retrieval and storage; and ensure the proper compilation, maintenance, and timely submittal of monthly caseload report.

Interpret state and federal agency administrative rules and regulations and their impact on Department actions and proposed actions; conduct complex legal research for the preparation of memoranda of law, and pleadings and in preparation for hearings and trials; and develop and maintain familiarity with Department issues, practices, and procedures through frequent consultation with Department staff.

Preparation and presentation of cases before administrative bodies; preparation of instruments, and pleadings; development of proposed rules, and regulations of the Department; provide legal advice and counsel to the Department; personally prepare or closely supervise the preparation of all documents relative to cases of major importance, provide advice and assistance to office operations that affect Administrative Procedures Ace (APA) requirements (e.g., Clerk of Agency Proceedings and subject matter indices) and advise Department offices on the operation of the APA; provide legal advice, counsel, and supervision of all rule development, implementation changes, and repeals.

KNOWLEDGE, SKILLS AND ABILITIES : Ability to motivate, develop, and direct staff as they work, identifying the best people for the job; knowledge of laws, legal codes, court procedures, precedents, government regulations, executive ordres, and agency rules; abillity to perform legal research and write legal memorandum; ability to travel when required; skill in preparing for hearings; ability to handle multiple tasks; abiltiy to organize and maintain files; ability to prioritze work assignments; skill in meeting deadlines; ability to access, input, and retrieve information from a computer database; knowledge of electronic mail; ability to use electronic mail; knowledge of word processing software; ability to use word processing software; ability to communicate effectively orally and in writing; ability to read and comprehend written material; ability to use correct spelling, grammer, and punctuation; ability to establish and maintain effective working relationships with others; ability to work effectively as a team member, and ability to work with internal and external customers in a tactful and courteous manner.

REQUIRED LICENSURE / REGISTRATION / CERTIFICATION : Must be a member of The Florida Bar.

OTHER JOB RELATED REQUIREMENTS : This position requires overnight travel. This position requires a Level I background check.
