Your role and responsibilities
This position will be a great opportunity for an attorney working in a dynamic team of IP professionals, responsible for trademark, copyright and domain issues globally. In coordination with senior legal team members, a typical day could include providing legal advice on all matters relating to:
- Trademark and Copyright: Direct management of clearance, prosecution, maintenance and enforcement of our growing US and foreign trademark portfolio, client counseling, licensing, developing and implementing intellectual property protection policies, and educating and coaching the business on intellectual property matters.
- Advertising: Clearance and claim substantiation involving compliance with federal, foreign, and state laws and regulations, including the Lanham Act, FTC Act, state unfair competition laws, deceptive trade practices, consumer fraud and industry-specific advertising laws, as well as keyword advertising issues.
- Claims: Advising on the validity of claims brought against Nasdaq, and the strength of claims you can bring against competitors, as well as advising on protection afforded by federal and state statutes, antitrust and non-competition laws, and the Lanham Act.
- Internet: Advising on trademark and copyright issues; DMCA safe harbors; antipiracy; ISP secondary liability; social network sites; cybersquatting; and massively multiplayer online gaming (MMOG).
- Anti-counterfeiting: Identification of assets at risk, developing internal policies, procedures, and draft documents (e.g., demand letters, notices of infringement, and settlement letters).
Another part of this role is to also:
- Stay current to provide relevant guidance on legislations and regulations around intellectual property that impact Nasdaq’s products and services; and
- Enforce statutory, regulatory and contractual obligations.
You will need the following skills and experience
- Law Degree (e.g., in the U.S., the Juris Doctor degree);
- Bachelor’s degree (or equivalent);
- At least 10 years’ experience from trademark and copyright practice, preferably in-house and/or at a top law firm; and
- Outstanding communication skills and the ability to simplify complex information.
