Job Description
Duties and Responsibilities
- Develop, implement, and maintain privacy policies and procedures to ensure compliance with applicable federal and state laws, including GLBA, CCPA, FDCPA, FCRA, TCPA, and other financial privacy regulations.
- Monitor regulatory and investor changes related to privacy and assess their impact on the company’s operations, updating policies as needed.
- Manage policies related to required federal and state privacy notices and web notices to ensure clear and accurate information is provided on how customer data is collected, used, and protected.
- Oversee processes related to capturing and adhering to consumer opt-out and opt-in preferences related to marketing, data sharing, text messaging, and similar functions.
- Conduct regular risk assessments and audits to identify and mitigate privacy risks.
- Provide training and guidance to employees on privacy regulations and best practices and raise awareness about privacy best practices and the importance of data protection within the organization.
- Collaborate with legal, IT, and compliance teams to ensure robust safeguards are in place related to data protection and privacy measures.
- Oversee the response to privacy incidents, working with internal and external stakeholders to mitigate risks and ensure proper notification procedures.
- Oversee processes related to responding to customer inquiries regarding their privacy rights, including access to information and data correction requests.
- Conduct after action reports when privacy incidents occur to determine the root cause and implement controls to prevent recurring incidents.
- Act as the primary point of contact for regulatory agencies and external auditors regarding privacy matters.
- Maintain records of compliance activities and prepare reports for senior management.
- Review and negotiate data protection agreements with vendors and third parties to ensure compliance with privacy standards.
- Performs other duties as assigned.
- Bachelor’s degree in business, law, finance, or a related field.
- Master’s or JD preferred.
- 5 years’ experience in privacy compliance, preferably in the mortgage or financial services industry.
- Certified Information Privacy Professional (CIPP), Certified Regulatory Compliance Manager (CRCM), or similar certification preferred.
- Experience with risk assessment, policy development, and regulatory compliance processes.
- Strong knowledge of mortgage-related privacy regulations, including the Gramm-Leach-Bliley Act (GLBA), Fair Credit Reporting Act (FCRA), and other applicable laws.
- Excellent communication, problem-solving, and leadership skills.
- Ability to work independently and collaborate with cross-functional teams.
- Ability to multi-task, respond well to pressure and deadlines, and work well individually and in a team environment. Flexible to changing priorities, project scopes, and deadlines. Ability to manage multiple tasks and projects
- Work well as an internal consultant in understanding business processes.
- Communicate exceptionally with enterprise class interpersonal skills (listening, comprehending, composing written communication, etc.)
- Strong Project Management, facilitation, and team leadership skills.
