At the North Dakota Securities Department, we are committed to our important mission of protecting investors and supporting legitimate capital formation. The Department regulates investment industry firms and professionals, and also regulates capital formation involving the offer and sale of securities.

We are seeking an Attorney with strong leadership and interpersonal skills, highly effective communication and collaboration skills, and exceptional legal research and analytical skills.

As the Attorney for the Securities Department, you will provide legal advice and opinions to the Securities Commissioner, oversee enforcement actions related to Department investigations and examinations, draft orders, rules and legislation, and represent the Securities Department in administrative hearings, legislative hearings, and civil court proceedings.

This integral role works in collaboration with the Department's team of investigators and examiners and may administer the provisions of the Securities Act in the absence of the Commissioner.

Hiring Salary: $90,000 - $115,000/year; dependent on experience

Location: This role is based onsite at our office location in Bismarck, ND.

Key Responsibilities:

  • Perform legal analysis and draft orders based on investigation and examination findings.
  • Represent the Department in administrative and civil proceedings.
  • Negotiate settlements.
  • Respond to interpretive opinion requests.
  • Provide legal advice to Securities Commissioner and team related to examinations, investigations, and enforcement matters.
  • Develop expertise and remain current on investment industry innovations, fintech and digital assets, fraud trends, and state and federal regulatory developments.
  • Coordinate with other securities regulators on multi-jurisdictional matters.

Minimum Qualifications:

  • A Juris Doctorate degree and a license to practice law in North Dakota.
  • Two years of work experience practicing law.

Preferred Qualifications:

  • Executive level composure and presence with the ability to work effectively under pressure.
  • Highly effective communication and collaboration skills.
  • Strong leadership and interpersonal skills, and the ability to work well with diverse constituent groups which may include fraud victims, industry representatives, attorneys, issuers, and other government agencies.
  • Exceptional legal research and analytical skills.
  • Work experience with the legislative process.
  • Work experience in the financial services industry or for a financial regulator.
  • Legal research and writing work experience.
  • Work experience providing legal representation during administrative hearings or civil or criminal proceedings in state or federal court.
  • Work experience drafting orders, rules, and legislation.
