GENERAL DESCRIPTION

The Transportation Division of the Texas Attorney General’s Office represents the Texas Department of Transportation in appeals before the Supreme Court of the United States, the Texas Supreme Court, the U.S. Court of Appeals for the Fifth Circuit, and all state courts of appeals. Appeals arise out eminent domain, torts, employment discrimination, contracts, and regulatory enforcement lawsuits. Appellate assistant attorney generals in the Transportation Division will encounter unique legal questions as they brief and argue for the State.

ESSENTIAL POSITION FUNCTIONS

Assistant Attorney General III:

  • Manages a docket of moderately complex and complex level appellate cases
  • Researches and drafts appellate briefs, prepares and delivers oral arguments, and handles all aspects of appeals and appellate-related trial matters.
  • Interprets laws and regulations
  • Reviews, evaluates, and renders legal opinions
  • Researches, prepares, and drafts legal memoranda
  • Provides legal advice and assistance to state agencies with regard to the above actions.
  • Performs related work as assigned.
  • Maintains relevant knowledge necessary to perform essential job functions.
  • Attends work regularly in compliance with agreed-upon work schedule.
  • Ensures security and confidentiality of sensitive and/or protected information.
  • Complies with all agency policies and procedures, including those pertaining to ethics and integrity.

Assistant Attorney General IV – All of the above functions for an AAG III, PLUS:

  • Manages a docket of advanced, complex level cases.
Qualifications


MINIMUM QUALIFICATIONS

Assistant Attorney General (AAG) III:

  • Graduation from an accredited law school with a J.D.
  • Experience: Two years full-time experience as a licensed attorney in appellate law
  • Licensed as an attorney by the State of Texas
  • Member in good standing with the State Bar of Texas and eligible to practice law in Texas by start date.
  • Skill in using a computer for word-processing and data entry/retrieval
  • Skill in effective oral and written communication [writing sample required prior to interview, if selected]
  • Skill in exercising sound judgment and effective decision making
  • Skill in conducting effective research
  • Interest in handling appellate matters
  • Ability to receive and respond positively to constructive feedback
  • Ability to work cooperatively with others in a professional office environment
  • Ability to provide excellent customer service
  • Ability to arrange for personal transportation for business-related travel
  • Ability to work more than 40 hours as needed and in compliance with the FLSA
  • Ability to lift and relocate 30 lbs.
  • Provides excellent customer service
  • Uses personal vehicle for business-related travel
  • Ability to travel (including overnight travel) up to 30%
  • Ability to work in person at assigned OAG work location, perform all assigned tasks at designated OAG workspace within OAG work location, and perform in-person work with coworkers (e.g., collaborating, training, mentoring) for the entirety of every work week (unless on approved leave)

Assistant Attorney General IV – All of the above qualifications for an AAG III, PLUS:

  • Experience: One additional year full-time experience as a licensed attorney

PREFERRED QUALIFICATIONS

Assistant Attorney General (AAG) III:

  • Experience representing the State in appellate matters
  • Judicial clerkship in federal or state appellate court
  • Experience participating in remote proceedings using Zoom or other teleconference software

Assistant Attorney General IV All of the above qualifications for an AAG III, PLUS:

  • Jury trial experience
