Associate Right of Way Agent

Summary

Working under general supervision, the incumbent serves as Oncor Electric Delivery Company’s (Company) representative in managing the Company right of way assets to protect and defend against exposure to potential encroachment, trespass, and environmental misuse. The incumbent will maintain owner/customer relations to prevent or minimize complaints, disputes and potential litigation.

Key Roles & Responsibilities:

  • Prepares legal documents such as easements, licenses, releases, exclusions, permits and encroachments, requiring paralegal skills and working knowledge of real estate law.
  • Research public and internal Company records to determine property ownership.
  • With general supervision, processes requests to use Company right of way for encroachments and grants of easement/license for third party uses such as crossings for utilities, roads, pipelines and other uses and, if approved, takes steps to prepare the pertinent documents for execution by Oncor’s Attorney in Fact.
  • Protects Company’s investment, title, and rights in its real property for both present and future use, preventing trespass, unauthorized encroachments, environmental misuse and maintenance concerns.
  • Provides general right of way assistance to Distribution Design and New Customer organizations relating to Company’s land and land rights.
  • Understands the importance of the integrity of Company’s standard real estate forms
  • With general supervision, processes the required documents for the acquisition and management of easements, licenses, leases and permits, associated with the construction of Company facilities affecting city, state, federal, and railroad lands.

Education, Experience, & Skills

  • High School Diploma or GED equivalent required.
  • An associate degree or one year of qualifying experience is encouraged to apply.
  • An International Right of Way Association Membership is encouraged to apply.
  • Basic knowledge of Company and Departmental policies and procedures, familiarity with real estate law, general knowledge of real estate industries practices, procedures, documents, public real estate records, and familiarity with regulatory and environmental rules and regulations.
  • Effective negotiating and interpersonal skills are essential.

Right of Way Agent

Summary

The incumbent carries out the direction of others, as negotiator and mediator, in representing Oncor Electric Delivery Company (Company) in acquiring distribution land and land rights. The incumbent manages the Company right of way assets to protect and defend against exposure to potential encroachment, trespass, and environmental misuse. The incumbent shall provide timely acquisition of easement rights and/or management of existing rights essential to the mitigation of system critical projects requiring reconductor, load transfer, system corrections, etc… The incumbent will maintain owner/customer relations to prevent or minimize complaints, disputes and potential litigation. The Incumbent may periodically assist in on-the-job training of Associate and Contract Right of Way Agents. The Incumbent shall, from time to time, engage and provide support to Contract Right of Way Agent(s).

  • Prepares legal documents such as easements, licenses, releases, exclusions, permits and encroachments, requiring paralegal skills and working knowledge of real estate law.
  • Research public and internal Company records to determine property ownership and performs abstract of title to locate easements and fee title deeds.
  • Processes requests to use Company right of way for encroachments and grants of easement/license for third party uses such as crossings for utility, roads, pipeline and other uses and, if approved, takes steps to prepare the pertinent documents for execution by Oncor’s Attorney in Fact.

  • With direction of others, provides guidance and assistance associated with Standard Form Right of Way document preparation, execution, and recordation to the Distribution Design and New Construction organization regarding new serve customers.
  • Researches and identifies the Company’s land and land rights and serves as the Company’s liaison between landowners and/or tenants to ensure cooperation and uninterrupted Company operations.
  • Provides guidance and assistance to Distribution Design and New Customer organizations with landowner notification and clarification of Company’s land and land rights.
  • Serves as the Company representative, with authorization to issue drafts/checks, in negotiating the settlement of damage claims resulting from the construction, maintenance or removal of Company facilities.
  • Assist others in meetings with Company staff, property owners, city governments, title companies, developers, engineering consultants and other entities to coordinate projects, resolve problems and reach agreements.
  • With supervision, trains Associate Right of Way Agents and Contract Right of Way Agents on Distribution Right of Way processes and procedures.
  • Determines easement values, using appraisal data, current right of way cost data, land use data, and production cost data, relevant to required easement acquisition on or across third party lands affected by proposed construction of Company facilities.
  • With direction of others, processes the required documents for the acquisition and management of easements, licenses, leases and permits, associated with the construction of Company facilities affecting city, state, federal, and railroad lands.
  • Oversees Contract Agents on extensive projects requiring review and approval of invoices, job activities, and schedule/deadlines to ensure compliance with task agreements and other contractual obligations to meet Company objectives.

Education, Experience, & Skills

  • High School Diploma or GED equivalent required.
  • An associate degree and one (1) year of related right of way experience, or two (2) years of related right of way experience, or IRWA Right of Way designation (RWA), or Texas Real Estate Salespersons license is encouraged to apply.
  • An International Right of Way Association Membership is encouraged to apply.
  • Working knowledge of Company and Departmental policies and procedures, and real estate law. Familiarity of eminent domain (condemnation) proceedings. General knowledge of real estate industries practices, procedures, documents, public real estate records, appraisal techniques, regulatory rules and environmental regulations.

Senior Right of Way Agent

Summary

Working with Minimal supervision, the incumbent serves as Oncor Electric Delivery Company’s (Company) representative in acquiring Distribution land and land rights essential for the construction and operation of the Company’s distribution facilities, managing the Company right of way assets to protect and defend against exposure to potential encroachment, trespass, and environmental misuse. The incumbent shall provide timely acquisition of easement rights and/or management of existing rights essential to the mitigation of system critical projects requiring reconductor, load transfer, system corrections, etc… The incumbent will maintain owner/customer relations to prevent or minimize complaints, disputes and potential litigation. The Incumbent acts as a negotiator and a mediator on behalf of the Company with respect to relocation of facilities, and the acquisition and protection of Company land and land rights. The Incumbent may periodically assist in on-the-job training of Associate and Contract Right of Way Agents. The Incumbent shall, from time to time, engage and provide support to Contract Right of Way Agent(s).

  • Provides guidance and assistance to Distribution Design and New Customer organizations with landowner notification and clarification of Company’s land and land rights.
  • Serves as the Company representative, with authorization to issue drafts/checks, in negotiating the settlement of damage claims resulting from the construction, maintenance or removal of Company facilities.
  • Conducts meetings with Company staff, property owners, city governments, title companies, developers, engineering consultants and other entities to coordinate projects, resolve problems and reach agreements.
  • Trains Company and Contract Right of Way Agents, Designers and New Customer Managers on Distribution Right of Way processes and procedures.
  • Ensures the integrity of Company’s standard real estate forms in situations involving proposed revisions and coordinate with the Company’s Legal when circumstances require.
  • Determines easement values, using appraisal data, current right of way cost data, land use data, and production cost data, relevant to required easement acquisition on or across third party lands affected by proposed construction of Company facilities.
  • Manages negotiations for acquisition of land and land rights to ensure that good faith negotiations lead to agreement and, if necessary, takes steps to acquire through eminent domain proceedings.
  • Serves as Company’s right of way subject matter expert, giving testimony, in hearings associated with eminent domain proceedings.
  • Processes the required documents for the acquisition and management of easements, licenses, leases and permits, associated with the construction of Company facilities affecting city, state, federal, and railroad lands.
  • Oversees Company and Contract Agents on extensive projects requiring review and approval of invoices, job activities, and schedule/deadlines to ensure compliance with task agreements and other contractual obligations to meet Company objectives.

Education, Experience, & Skills

  • High School Diploma or GED equivalent required.
  • A bachelor's degree and four (4) years of related right of way experience, or seven (7) years of related Right of Way Experience, or IRWA Senior Right of Way designation (SR/WA), or Texas Real Estate Salesperson/Broker license is encouraged to apply.
  • An International Right of Way Association Membership is required; a Senior Right of Way (SR/WA) designation and/or a Texas Salesperson’s/Broker’s License is encouraged to apply
  • Working knowledge of Company and Departmental policies and procedures, working knowledge of real estate law, special knowledge of eminent domain (condemnation) proceedings, knowledge of real estate industries practices, procedures, documents, public real estate records, appraisal techniques, and familiarity with regulatory and environmental rules and regulations.
