?Personal Services: In accordance with 10 U.S.C 1091 the Optometrists are under a Personal Services arrangement on this Task Order.
It is expressly agreed and understood that the physicians are a non-personal services contract, as defined in Federal Acquisition Regulation (FAR) 37.101, under which the professional services rendered by a contract service provider are rendered in their capacity as an independent Contractor or employee of any
independent company that may be a party to this contract. The Government may evaluate the quality of professional and administrative services provided, but retains no control over the medical or professional aspects of the services rendered (e.g. professional judgments, diagnosis for specific medical treatment). The Contractor shall be solely liable for and expressly agree to indemnify the Government with respect to any liability producing acts or omissions by its employees or agents. This contract does not create an employer- employee relationship between the Government and any corporation, partnership, business association or other party or legal entity with which the individual contract service provider may be associated. Contract personnel rending the services are not subject, either by the contract terms or by the manner of its administration, to the supervision and control usually prevailing in relationship between the Government
and its employees.
In accordance with FAR Clause 52.237-7 Indemnification and Medical Liability Insurance. The Contractor shall be solely liable for and expressly agrees to indemnify the Government with respect to any liability producing acts or omissions by it or by its employees or agents. The Contractor shall maintain during the term of this contract liability insurance issued by a responsible insurance carrier of not less than the following amount(s) per specialty per occurrence: $1,000,000.00 per occurrence and $3,000,000.00 in the aggregate.
1.5.6. Recognized Holidays: Contract HCWs ?will ? will not be required to work on federally recognized holidays.

1.5.7.1. Hours of Performance (Ophthalmology Clinic/Refractive Clinic and DRC: The performance hours of the MTF are as follows: Duty hours shall be as set forth by the applicable Department Chief or his/her designated Duty hours shall be as set forth by the applicable Department Chief or his/her designated government representative. The Contractor shall provide services for work weeks averaging 40 work hours consisting of five (5) eight (8)- hour work shifts scheduled Monday thru Sunday between the hours of 6:00 a.m. and 10:00 p.m. The clinic supervisor will schedule shifts. Possible shifts may be any consecutive nine (9) hours between 6:00 a.m. and 10:00 p.m. A minimum 30-minute, or 45 minute, and not to exceed a one (1)-hour unpaid meal break provided during the shift (as determined by the department) which is not paid by the Government. The above timeframes are subject to change by mutual agreement of the government and the contractor. The actual schedule will be determined by the government supervisor and is subject to change due to changing mission requirements. The Contractor shall only be paid for actual hours worked. Hours scheduled for shifts do not include travel time involved in reaching the medical treatment facility or work site.
• The Contract HCW shall be rested and fully physically and mentally capable for performing the duties required under this contract.
• Unpaid meal breaks (lunch) are mandatory daily.
• HCWs cannot work through unpaid meal break to accommodate late arrival or early departure as that is considered unauthorized compensatory time.
• There is no set time for unpaid meal breaks and times may change daily; however, the unpaid meal break must be taken within the scheduled shift. Unauthorized working through unpaid meal breaks are not billable.
• Unpaid meal breaks are based upon patient care workload. A Government representative will release HCWS for unpaid meal breaks.
• Government representatives may at times be involved in extreme demanding and busy situations
therefore HCWs have a responsibility to approach Government representative if it is realized an unpaid meal break has not been provided so one can be afforded.
• Clocking in prior to scheduled times will not be considered as hours worked.
• Staying late past scheduled times will not be considered as hours worked unless requested by the
Government and approved due to the Government’s mission.
• Signing in prior to schedule or stay late past scheduled time to complete mandatory training is not authorized. All training must be done during normal duty hours
• The contract HCWs shall not leave the hospital during designated shift hours (excluding meal breaks) or without prior coordination with the Clinical Supervisor. Time away is not considered actual hours worked.
• Completing contract vendor requirements while on Government time is not authorized and not
considered actual hours worked.
• Additional shifts may be added or changed with the agreement of the Contractor and the COR to include less than eight (8) hours per shift or up to (and not to exceed) 12-hour shifts, Sunday through Saturday, including nights, weekends, and/or holidays.
• Hours worked do not include travel time to reach the Military Treatment Facility (MTF) or other place of performance.
· Possible shifts for the Ophthalmology /Optometry Clinics include the following:
0600-1430 w/30 min lunch
0600-1500 w/1-hr lunch
0630-1500 w/30 min lunch
0630-1530 w/1-hr lunch
0700-1530 w/30 min lunch
0700-1600 w/1-hr lunch
0730-1600 w/30 min lunch
0730-1630 w/1-hr lunch
0800-1630 w/30 min lunch
0800-1700 w/1-hr lunch
1.5.7.2. Scheduling (Ophthalmology Clinic/Refractive Clinic and DRC): The schedule or scheduling process is as follows: Shift hours or length may be adjusted to meet the health care needs of the MTF, its’ associated healthcare sites or by mutual agreement between the government and the contractor. Shifts may include weekends, Federal and Fort Cavazos Training Holidays. The government will only pay for actual hours worked. The government shall maintain scheduling requirements for the contract Personnel.
Place of Performance: (Ophthalmology Clinic/Refractive Clinic and Deployment Readiness Center) The work to be performed under this contract for the Optometrists will be at Carl R. Darnall Army Medical Center, Fort Cavazos, TX. HCWs shall receive notification one (1) week prior to the reassignment to another location.
1.5.9. Mission Essential: The following labor categories are designated as mission essential: Optometrists

1.6.9.2. Computer Skill Competency: Each HCW shall demonstrate competency as required in the contract and as follows:
· Position requires access to Department of Defense computer systems,
therefore HCWs shall be a U.S. Citizen or otherwise meet the requirements of
AR 25-2 and any electronic record systems HCWs may be required to utilize in
the performance of assigned duties.
· Shall be able to type and have had experience using computers especially Microsoft
programs. CRDAMC will provide computer training for the CRDAMC computer system.
· Shall be able to read, write, and speak English well enough to
effectively communicate with patients and other healthcare providers.
1.6.10. MTF Training: Additional training requirements are as follows: Computer Training. Contract providers who have any interaction with the MTF computer systems must receive training for the applicable system. All Contractor staff that access Government IT systems shall be trained in security awareness, protection of Government sensitive and privacy information, and their responsibility and consequences before access is authorized. The COR or appropriate Government designee will coordinate computer training. The training will be on-site and during normal duty hours. This training will be at no cost to the Contractor. Training is not reimbursable to the Contractor if completed off-site.

The Government may elect to provide unique Government training to contract personnel who are
performing services under this contract. If the Government elects to provide such training, the Government will provide such training at no additional expense to the Contractor or to the contract personnel. When directed by the contracting officer, contract personnel shall attend all such training in a paid status as part of the normal services required and billed under the contract. If determined by the contracting officer, such training may require a performance commitment by the Contractor and the Contractor shall reimburse the Government (by means of a reduction in an invoice) if a contract personnel fails to satisfy the performance commitment after the contract personnel receives the unique Government training.
1.6.12. MTF Standards: Specific policies, procedures, and instructions/regulations for the place of performance are as follows: All services shall be provided in accordance with established standards, principles and ethics of the profession and applicable professional specialty organizations, The Joint Commission (TJC) standards, applicable Department of Defense (DoD) and service specific regulations, directives and policies, as well as MTF policies, procedures and job descriptions. Contract HCWs shall give the highest regard to patient dignity and observe the precepts of the American Hospital Association's Bill of Rights for Patients. Contract HCWs shall provide services in conjunction with other non-contract providers to include physicians, nurse practitioners, physician assistants, registered/licensed practical nurses and support personnel. All contract HCWs shall perform essentially the same functions, within the scope of acceptable practice, as those required by Army or government service health care professionals of similar experience and in similar duty assignments.
1.6.20.3. Occupational Health: The HCW ?shall ?shall not be required to obtain
documentation of required physical testing or a report of a physical examination. This list
may change at the direction of Occupational Health.
· MMR vaccine – 2 doses or Rubella, Rubeola and Mumps igG titers showing positive results (if
needed, must be taken no less than two (2) weeks prior to report date)
· PPD (TB skin test) - 2 tests within the past 12 months or a QFT Gold showing negative results
within the past 12 months. A copy of a chest x-ray if you have a history of a positive TB test
· Varivax vaccine (chickenpox) – 2 doses or Varicella igG titer showing positive results
· Influenza vaccine (flu shot) - annually
· Hepatitis B vaccine - 3 doses or HBsAB showing positive results (health care providers only)
· BCLS, PALS, etc cards (if required)
· COVID-19 Certification (if required)

1.6.20.5. Tuberculosis Screening: The additional immunization/screening requirements for the risk of exposure to tuberculosis (TB) are as follows:
· Tdap vaccine within last 10 year
1.6.20.6. COVID-19 Vaccine, Exposure, and Positive Results: Per HCWs must adhere to any updated guidance as distributed by the Provost Marshals Office and Command as released on screening, vaccination, exposure, and positive results. CRDAMC/MEDCEN Command Policy 20-039, COVID-19 Healthcare Personnel Sustainment Policy, CRDAMC’s intent is to maintain a safe and healthy workforce to serve Ft. Cavazos’s beneficiary population, patient & staff safety, and support the III Corps mission. COVID- 19 statistics, data, and compliance is recorded and reported up the CRDAMC Chain of Command to MEDCOM, DHA, Department of Army, State of Texas, and Center for Disease Control (CDC). Due to the critical nature of the COVID-19 pandemic, adherence
to requirements are mandatory and require 100% compliance. It is critical that all personnel practice rigorous and regimented hand hygiene, cough and sneeze discipline, social distancing when applicable, the wear of face coverings and appropriate personal protective equipment (PPE), and vigilant assessment and reporting of personal health status. PPE will be provided by the Government for direct health care providers. Time away from the facility for screening, testing, vaccination, quarantine, or any COVID-19 related illness is not considered actual hours worked and is not billable.

Labor Category: Optometrist
HCW Qualifications (Contract PWS 5.2; 5.2.3; 5.2.4; 5.2.6.4.4):
· Degree/Education (5.2.4): Doctor of Optometry. Graduate from a school or college approved by the Accreditation Council on Optometric Education (ACOE) of the American Optometric Association.
· Certifications (5.2.3): Contract workers shall maintain current certification in Basic Life Support (BLS) from the American Heart Association, or the American Red Cross. Certification cards must display the American Heart Association, the American Red Cross or other approved certifying body emblem. Web-based (on-line) classes are not acceptable by the Government.
· Experience: Must have worked one year in the last two years as an optometrist.
· Board Certification (5.2.6.4.4): None required however the board certification recognized for optometrists is from the Fellowship in the American Academy of Optometry (FAAO), American Board of Optometry (ABO), and The American Board of Certification in Medical Optometry (ABCMO).
· Licensure/Registration: Contract workers requiring licensure shall have and maintain a
current, valid, unrestricted license specific to the position (with no limitations, stipulations or
pending adverse actions) in one of the 50 US States and/or territories. Additional licenses held by a provider must be in good standing whether they are inactive, expired, or limit the provider’s practice to a military setting. The healthcare provider’s license(s) must remain current, valid, and unrestricted throughout the duration of the contract worker performance on the contract. The DHA PM 6025.13, vol 4, is the governing directive for all licensure, registration, and certification. Adherence to the outlined requirements within the DHAPM 6025.13, vol. 4, shall be met.
HCW Duties (5.1 Task 1): The duties for the HCW are as follows: For Carl R. Darnall Army Medical Center, Ophthalmology Clinic/Refractive Clinic Serves as the full-time primary eye care provider for the WRESP performing the full range of professional optometric duties with major emphasis in the pre-operative evaluation of refractive surgery patients and the post-operative evaluation and management of refractive surgery patients with the assistance of staff ophthalmologists. Examines, diagnosis, treats diseases and disorders of the visual system, the eye, and associated structures as well as diagnosis related systemic conditions. This includes, but is not limited to, diagnosis and medical treatment of eye diseases such as conjunctivitis, iritis, episcleritis, blepharitis, glaucoma, epithelial defects, recurrent erosions, complications of refractive surgery, etc., and eye injuries such as corneal abrasions, ocular foreign bodies, chemical and thermal burns of the eye. Performs comprehensive and limited visual and ocular examinations on all types of patients; including, but not limited to refractive surgery patients, pediatric patients, adult patients, geriatric patients, learning disability patients, low vision patients, contact lens patients, and patients who work in eye hazardous occupations. Provides the proper diagnosis, management, and treatment of all patients that are within the scope of optometric practice and credentials.

General Optometry: Examine, diagnose, treat or prescribe courses of treatment for those suffering from diseases, injuries, or disorders of the visual system, the eye, and associated structures as well as diagnose related systemic conditions. Promote prevention and wellness, vision conservation, education and training activities, vision screenings, and positive eye and vision health behaviors. Conduct vision research in a problem area of considerable scope and complexity which requires novel approaches and which results in answers to important questions or important changes in existing methods and techniques. Advise and make professional clinical recommendations as to courses of action on problems and considerations of national scope in all areas of optometry. Provide full spectrum of clinical services to treat the most complex optometric related patient conditions.
