The duties that the incumbent of the vacancy will be expected to perform. Duties Description The Assistant Counsel, NS-27, in the Rates and Utilities Section of the Office of General Counsel (OGC), applies demonstrated abilities and experience beyond entry-level with increasing responsibility and complexity of work, commensurate with achievement and aptitude. Under the direction of managing attorneys, duties include, but are not limited to: • Analyzing applications and petitions for Public Service Commission (Commission) action on utility requests for rate increases, tariff changes, and other matters.• Providing advice to the Commission on behalf of the General Counsel.• Preparing memoranda on legal issues related to actions of the Commission.• Ensuring that all Commission processes are carried out lawfully in conformance with the procedural requirements of the Public Service Law, the State Administrative Procedure Act, the State Environmental Quality Review Act, the Climate Leadership and Community Protection Act (CLCPA), and the Public Officers Law.• Advising other divisions, as needed, on legal aspects of pending cases.• Drafting orders and other documents to effectuate Commission decisions.• Processing, analyzing, and reporting to the Commission on applications for rehearing or reconsideration of its determinations.• Leading staff preparation and presentations in Commission proceedings set for hearings, negotiations, and alternative dispute resolution.• Analyzing issues, studying the law and, when appropriate, preparing cross-examination of witnesses in all types of proceedings conducted by and before the Commission.• Representing and participating in the Department’s advocacy staff administrative proceedings related to utility rates and/or siting of transmission and renewable energy facilities. • Coordinating the development and adoption of Commission rules and policy statements; and otherwise participating in staff team efforts apart from administrative proceedings.• Assisting the public in understanding and being involved in Commission processes.
The minimum qualifications required for this vacancy. Minimum Qualifications Law degree and three years of experience as an attorney. Must be admitted to the New York State Bar.
