Job Description
- Participates in the development of policies and procedures regarding conducting guardianship proceedings for those deemed incapacitated by the Superior Court of New Jersey, while adhering to various statutes, federal and state laws.
- Assists in providing guidance to care managers, financial managers and investigators in the performance of duties, to ensure adherence to laws, regulations, case law and court-mandates.
- Assists in representing wards at administrative law hearings to advocate for clients’ government entitlements, including hearings for denial of Medicaid eligibility; hearings for denial of Social Security Disability payments; etc.
- Assists in filing and defending all lawsuits and legal actions on behalf of OPG wards, including sales of homes, cars and other valuables; familial/civil court matters such as separations, child support and divorces; lawsuits due to car accidents and other liabilities; etc.
- Assists in conducting guardianship proceedings in the Superior Court of NJ, including reviews pleadings for recommendations as to whether to accept new cases; assists with investigations; drafts proposed court orders.
- Appears in Superior Court on appeals of regulatory decisions and related matters by wards' family members, powers of attorney, etc.
- Assists in representing client in any actions concerning its fiduciary responsibility.
- Files and defends First and Final Accountings with the Superior Court of NJ at the termination of Guardianship, demonstrating that client has carried-out its obligations in accordance with the law and the specific mandates under which it was appointed Guardian.
- Assists in identifying and pursuing suspected cases of abuse, neglect and/or financial exploitation against clients and works with the "Financial Abuse and Advocacy Specialist Team" and the Office of the Attorney General to prosecute financial exploitation cases.
Additional Details:
Hours: 9-5 Monday through Friday
Schedule: hybrid (3 days onsite, 2 days remote)
Duration: contract to hire
Start Date: client is looking to interview and start a candidate within the next 2 weeks
Requirements: candidate must be NJ licensed; ideal candidate will have 2 years of guardianship or trust & estate experience
Salary : $40 - $50
