Position Summary
Senior Compliance Specialist is responsible for the evaluation and monitoring of properties in an assigned region to assure compliance with applicable affordable housing programs. Keeps current on all changes in regional affordable housing regulations and assists in the distribution of this information to Asset Management and Property Operations staff on a regional basis. The candidate must be knowledgeable in HUD, LIHTC, Section 8, and Section 236 rules and regulations, and ensure that all properties are fully compliant and audit-ready. Mandatory certification in one or more of the following: COS, C3P, HCCP, NCP, CSC, CLS, and/or any LIHTC certification.
Essential Functions and Responsibilities:
Maintain and ensure compliance with all affordable housing programs, regulatory requirements, and compliance procedures for the portfolio.
Responsible for the development and implementation of compliance policies and procedures. This includes researching laws, case precedents, and legislative intent to recommend policy direction to the Senior Director, Asset Management.
Keep current on all updates and changes in affordable housing programs and requirements.
Assure that Property Operations personnel in the assigned region receive clear and concise written interpretations of changes.
Develop, implement, and maintain file audit procedures in the region(s) to ensure compliance with regulatory agreements for each property. Duties include, but are not limited to:
Ensuring that all tax credit project first-year tenant files are 100% in compliance.
Ensuring that all tax-exempt bond project first-year tenant files are 100% in compliance.
Ensuring that HUD project tenant files are 100% in compliance.
Schedule/coordinate all ongoing file reviews and audits: Test verification of tenant income for HUD, tax credit, and tax-exempt bond projects. Test periodic tenant recertifications to ensure compliance with HUD, MFTE, ARCH, tax credit, and tax-exempt bond requirements. Verifying compliance with Fair Housing standards. Periodic tours of property sites to monitor compliance with safe, sanitary housing standards. Review of the periodic REAC physical inspections. This will include follow-up on corrective measures with Regional Management staff.
Provide technical guidance to compliance teams, property managers, asset managers, or outside organizations on program regulations and guidelines.
Partner with the Senior Director, Asset Management to design, develop, identify, and provide compliance training. This includes making presentations orally and writing to explain policy and procedures.
Perform support tasks with the Senior Director, Asset Management on standards, procedures, goals, objectives, and action plans related to compliance. Responsible for identifying areas of weakness, and non-compliance, and creating corrective action plans.
Mentor, train, and supervise compliance personnel and third-party file review service contracts.
Ability to hold and manage coordinator titles for the HUD EIV submission system.
Maintain, establish, and/or coordinate submission for all regulatory reporting for portfolio.
Act as liaison with clients and agencies regarding affordable compliance regulations to ensure program compliance, and consult with regulated entities to identify problem areas and improve
Provide orientation and training to Property Managers. This may include initial orientation of new staff as well as re-orientation of existing staff.
Responsible for regional deployment of additional compliance policies, procedures, and file documentation for HUD, tax credit, and tax-exempt bond projects.
Support Property Managers in developing and deploying corrective action plans based on internal or external audit findings.
First-Year Compliance: Ensure that all tax credit projects and all bond projects for the first-year tenant files are in 100% compliance and have been copied and filed in an “off-site” and/or central location.
Requirements:
A combination of education and related experience may substitute for education requirements; however, achievement of degrees and related experience is preferable.
BS in Real Estate, Finance, Business, or a related field and 5 or more years experience in property management, asset management, or housing regulatory organization/agency with an emphasis on compliance oversight.
Current compliance certificate – HCCP, C3P, NCP, CSC, CLS, LIHTC, COS, etc.
Knowledge of Affordable Housing, Fair Housing laws, property management/operations, and practices.
Legal document analysis pertains to compliance and affordable housing codes.
Strong analytical, financial, and problem-solving skills.
Excellent verbal and written communication skills
Ability to present complicated financial transactions in a manner that is easily understood
Must be an excellent team player capable of working with relationships with staff, regulatory agencies, lenders, property management companies, and other business stakeholders.
