The role :
The Senior Vice President, Litigation manages the litigation staff and the Corporate Appearance team with support from the VP, Litigation and supervising attorneys on the team. The SVP will manage the portfolio of litigation, contested foreclosures, service of process and third party subpoena processes. The SVP, Litigation will oversee all communications with clients and ensure timely and accurate case management reporting and lead monthly meetings. This role will also provide litigation information and analytics to Selene leadership on litigation matters, financial reporting and reserve analysis, preparing monthly litigation materials and participate in investor and rating agency due diligence reviews. The SVP will also manage external counsel relationships including selection and on-boarding of new firms, fee arrangements, firm billing, budget approvals, timelines, strategy and settlement negotiations. The SVP will be responsible for overseeing assigning matters to litigation analysts, conducting side by sides with the team to ensure appropriate case management, evaluating and reporting monthly on team performance, and escalating high risk matters to executive and senior leadership, preparing the team for monthly case review meetings with clients and preparing case summaries and client reports. In this role, the SVP, Litigation will interact with clients, Servicing Operations leadership and will work closely with the VP of Litigation. This position will also require the SVP to handle a small caseload of complex litigation matters. Additionally, the SVP role will consult with Servicing management in addressing operational issues and risk remediation efforts of primary drivers of litigation. Responsibilities will also include reviewing and supporting Legal, Compliance, Correspondence and Servicing Operations in the investigation and review of escalated complaints related to Servicing Operations with remediation efforts to address the root cause of the complaint with Servicing leadership.
How you will contribute :
- Oversee litigation portfolio and matter assignments to team to ensure proper case management.
- Prepare litigation reserve analysis and related financial information for litigation docket and report updates to Finance on a monthly basis.
- Review and approve litigation budgets, updates and monthly invoices for litigation spend.
- Work closely with litigation case managers and external counsel to review cases for prompt resolution and analyze settlement offers.
- Assign all new matters received in the Litigation centralized mailbox and Legal Tracker to the appropriate team member in a timely manner.
- Maintain responsibility for management of shared mailboxes (including, but not limited to, Litigation and ROGGS) to ensure all inquiries are delegated and responded to in accordance with department P&P.
- Manage team of direct reports providing staff with regular performance feedback on established metrics via scorecards and other forms of communication.
- Notify GC of high-risk matters upon intake (class actions, Selene named, etc.).
- Serve as administrator of Legal Tracker and ensure that case details are updated and remain current with case developments, exposure analysis, client updates and reports are run with the most current information on the status of the litigation, strategy, exposure and upcoming critical events and dates.
- Review all settlement agreements and confirm terms were prior approved by client in writing, execute settlement agreements on behalf of client, when authorized by client.
- Prepare, review and respond to insurance claims coverage requests and indemnification requests.
- Generate daily reports to ensure team compliance with timekeeping requirements.
- Provide training to new and existing litigation staff and Corporate Appearance team as requested.
- Provide additional coverage of litigation matters when individual team members are out of the office.
- Schedule trainings / CLE's for the team with internal resources and outside firms.
- Prepare summary of cases and lead discussions with counsel and investors, Servicing leadership.
- Track and follow-up with litigation analyst and counsel on hearings, motions, pleadings, etc.
- Provide support to and work closely with the Corporate Appearance team and external counsel on depositions and preparation for testimony at trial.
- Analyze industry case decisions and potential impact on Selene operations and clients.
- Assist with the investigation and review of escalated complaints and responses; recommend mitigation measures to prevent future incidents.
- Identify gaps in company policies and procedures which allow breakdown leading to contest or litigation and makes suggestions to correct processes, if applicable.
- Manages inquiries by responding to emails, intercoms, handling appropriate document execution, and other related tasks.
- Provide feedback to VMO and default servicing on firm scorecards, audits, case file reviews, file transfers, risk mitigation and performance of default firms.
- Participate in calls and meeting with Loan Boarding and Client management on file transfers, loan sales and securitizations for loans with active litigation.
- Work with Servicing Operations to establish internal controls to reduce errors and customer complaints related to litigated matters.
- Develop and maintains department policies and procedures related to litigation.
- Provide coaching, training, and development to staff to ensure company and department goals and key performance indicators (KPIs) are met.
- Measure and document staff performance, attendance and compliance with job duties, expectations, regulations, guidelines, policies, and procedures.
- Prepare and provide monthly reports and analytics to Finance, senior management, clients and due diligence reviews.
- Prepare annual audit letter external auditors for litigation matters.
- Strategic planning to achieve organization goals.
