VACANCY: At present there is one (1) vacancy with the Seneca County Attorney’s Office. RESIDENCY: Seneca County’s residency requirement of residency in Seneca County or contiguous county for 30 days has been waived for this position. Candidates must be legal residents of New York State at time of application. Preference in appointment may be given to successful candidates who have been legal residents of the municipality in which appointment is to be made for at least one month prior to the date of application and are residents of such municipality at the time of appointment. TYPICAL WORK ACTIVITIES: (Illustrative Only): • Responsible for all courtroom representation of DHS in proceedings under the Family Court Act. This further includes representation of the County’s interests in the Support part of Family Court. • Responsible for all orders, reports, trials, post-trial actions and appeals, including drafting and appearances. • Acts as the presentment agency, assists in requests from law enforcement of probation in the initial stages of Juvenile Delinquency proceedings, as well as Juvenile Offenders, as may arise under “Raise the Age” legislation. • Coordinates with the District Attorney as necessary for investigations as well as the drafting of all petitions and applications to the Family Court. • Provides all courtroom duties, continued representation through appeals or alternative dispositions. • Acts as the legal source for all matters relating to PINS, to include coordination between DHS and Probation resources. • Drafts all petitions and applications to Family Court. • Provides all courtroom duties; • Represents the County through appeals or alternative dispositions. • Provides assistance, as necessary, for Fair Hearing matters involving CPS related matters. • Acts as responsible attorney for Medicaid qualification questions posed, particularly regarding trusts, Special Needs Trusts, Spousal Refusal, and similar matters. • Develops experience and maintains currency in Medicaid qualifications and asset protection strategies to limit Medicaid exposure. • Works with the resources paralegal or assistant to assist in the resolution of litigation or claims matters with 3rd parties and HMS. SUGGESTED OR PREFERRED MINIMUM QUALIFICATIONS: Admission to the bar of the State of New York.
