Position Overview:
We are seeking an experienced Labor & Employment Attorney with 5 to 7 years of experience to join our dynamic team. This is a unique opportunity for a highly motivated attorney looking to take their career to the next level. The ideal candidate will have expertise in both advising clients on day-to-day labor and employment matters as well as representing them in complex litigation. Key Responsibilities:
· Employee/Plaintiff Representation:
- Represent employees in disputes related to discrimination, harassment, wrongful termination, wage and hour claims, retaliation, and other workplace issues.
- Counsel clients on their legal rights, develop case strategies, and manage all phases of litigation, including drafting complaints, conducting discovery, and handling pre-trial motions.
- Advocate for clients in hearings, trials, and mediations, ensuring effective representation in court and before administrative agencies.
· Employer Defense and Counsel:
- Defend current employer clients in employment-related claims such as wrongful termination, harassment, wage and hour violations, and discrimination.
- Advise employers on legal compliance with federal, state, and local labor laws, such as FMLA, FLSA, ADA, and Title VII.
- Review workplace policies, employee handbooks, and guidelines to mitigate risks and enhance organizational compliance.
- Provide strategic guidance on internal investigations, terminations, performance management, and dispute resolution.
· Strategic Counsel and Risk Mitigation:
- Offer proactive legal counsel to employers to help them avoid litigation, including advising on personnel decisions, employee discipline, and compliance with labor regulations.
- Assist employers in navigating complex labor and employment challenges, balancing the needs of the business while ensuring legal and ethical compliance.
· Litigation Management:
- Manage cases from initial intake through resolution, including trial preparation, discovery, depositions, and settlement negotiations.
- Prepare and argue motions, and represent clients at hearings, arbitrations, and mediations.
- Work collaboratively with senior attorneys to develop legal strategies and achieve favorable outcomes for clients.
Qualifications:
· Juris Doctor (JD) degree from an accredited law school.
· 5 to 7 years of experience in labor and employment law, with a focus on both counseling and litigation.
· Proven ability to manage client relationships and maintain strong communication with stakeholders.
· Experience representing clients across diverse industries.
· An entrepreneurial mindset with an interest in business development and growing a practice.
· Active admission to the state bar in Maine.
