What are the responsibilities and job description for the Drug Screen Technician position at Smith County?
Observation and collection of urine samples from probationers of the same gender.
According to the EEOC in §625.4(b), one element in the final determination of the validity of an employer's sex Bona Fide Occupational Qualification (BFOQ) claim is an analysis of whether the "essence" of the employer's business would be undermined by not excluding all members of one sex from consideration for the position in question.
Due to the observed nature of the urinalysis drug testing, a gender specific BFOQ in its hiring is valid. Female technicians may only observe female clients, and male technicians should only observe male clients.
