Introduction

The Office of the Secretary provides leadership, overall policy guidance, and central administrative services to support the Department of Natural Resources and Environmental Control (DNREC).

Summary Statement

This position reports to the Deputy Secretary of the Department of Natural Resources and Environmental Control (DNREC) and works in the administrative law section. This position has the primary responsibility of coordinating, streamlining, and ensuring consistent implementation of enforcement and compliance policies (e.g. Compliance and Enforcement Response Guide), designing/developing statewide or case-specific enforcement strategies, and acting as DNREC’s primary liaison internally and externally on departmental compliance and enforcement policy. In addition, the position is the lead Freedom of Information Act (FOIA) coordinator for DNREC and is responsible for ensuring consistency in responses across Divisions and coordinating FOIA responses that include more than one Division. The position is also the liaison with DNREC’s attorneys in the Department of Justice’s Environmental Civil Unit. The position may also perform limited legal research and legislative drafting.

Essential Functions

  • Ensure timely, appropriate and consistent administrative and civil enforcement actions department-wide through serving as administrator of the Department Enforcement Panel.

  • Assist the Department's attorneys on multi-media/cross-program cases and FOIA requests where coordination of Department efforts and information will allow more timely actions.

  • Coordinate with the Divisions to assist in tracking deliverables for global administrative and civil enforcement actions and settlement agreements.

  • Monitor and provide comments to Department management on new/proposed legislation.

  • Facilitate the Department's compliance and Enforcement Workgroup and revise/update the Compliance and Enforcement Response Guide ("CERG") when necessary and/or directed by Senior Dept. Management.

  • Review/update/revise enforcement and/or FOIA related Departmental policies and procedures.

  • Serve as the Department’s Freedom of Information Act ("FOIA") Coordinator.

  • Respond to requests for information from EPA, environmental agencies of other states, Environmental Council of the States (ECOS), other State of Delaware agencies, legislators, and/or Delaware citizens regarding Department regulations or civil/administrative enforcement matters.

  • Act as liaison for cross-program EPA initiatives, such as the State Review Framework (SRF) Enforcement and Compliance Audits, as initiated by US EPA.

  • Serve as SME and/or participate on interviews throughout Department as requested/needed.

  • Perform legal research as assigned.

Applicants must have education, training and/or experience demonstrating competence in each of the following areas:

1. Possession of an Associates Degree or higher in a related field accompanied by a Paralegal Certificate from an ABA-accredited program, or possession of a J.D., LLB or related degree.

2. Three years’ experience in public policy administration, which includes overseeing and directing the development, implementation, and evaluation of public policies.

3. Three years’ experience in legal research, which includes researching statutes, regulations, case laws, and background information.

4. Six months’ experience in interpreting legislation, statutes, and regulations.

5. Knowledge of staff supervision, which includes planning, assigning, reviewing and evaluating the work of others.
