The Work You Will Do:

 

You will provide legal services to the different divisions within the Department under the direction of the General Counsel, the Deputy General Counsel(s), and Attorney Supervisor.

The Department’s Office of General Counsel works closely with the Department’s divisions and various program areas to provide legal assistance and advice that is responsive to the specific needs of the Department, division, or program area. The Office of General Counsel serves the entire Department in many different capacities including rendering legal advice and opinions to Department staff in the areas of Economic Development, Community Development, Workforce Services, Human Resources, Reemployment Assistance, and Finance and Administration.

 PAY: $80,000 – $90,000 Annually

 

 

Your Specific Responsibilities:

  • The attorney in this position provides legal services to Department administrators under the direction of the General Counsel, the Deputy General Counsel(s), and Attorney Supervisor.
  • Serves as legal counsel to the Department divisions on various issues and matters, including providing assistance in developing policies, drafting and reviewing agreements, and reviewing and interpreting both federal and state laws and regulations.
  • Assists with all phases of the Department’s procurement and contracting process by providing legal opinions, developing procurement documents and contracts, attending public meetings, and reviewing and approving contracts to ensure that they meet all applicable state and federal requirements and ensure adequate legal protection for the Department.
  • Drafts, reviews, and revises contracts, public solicitation documents, administrative policies, and rules. Prepare and update procurement and contract template documents. A strong understanding of federal and state administrative law, federal civil rights statutes, 2 C.F.R. § 200, and government contracting is required.
  • Handles bid protests and other litigation involving procurements for the Department, including litigation in administrative forums, as well as in all levels of state and federal court. 
  • Makes legal determinations as to whether rulemaking is required by the Florida Administrative Procedures Act and applicable case law, and assists in developing, drafting, and promulgating rules for all program areas of the Department when rulemaking is required; conduct public hearings and workshops on proposed rules; respond to Joint Administrative Procedures Committee staff on rules; and interpret and provide legal opinions on application of Department rules.
  • Handles litigation for the Department, including litigation in administrative forums as well as in all levels of state and federal court. 
  • Conducts legal research.
  • Assists in drafting and reviewing proposed legislation and review bills passed into law for applicability, effect, and implementation.
  • Handles requests for public records and respond on behalf of the Department to subpoenas and court orders.
  • Perform other duties as assigned.

 

Required Knowledge, Skills, and Abilities:

 

  • Must be team-oriented and have an ability to build and maintain strong working relationships with co-workers.\
  • Ability to engender confidence from agency leadership.
  • Ability to multi-task in a fast-paced environment.
  • Ability to work independently with attention to detail.
  • Working knowledge of Chapter 120 administrative proceedings.
  • Working knowledge/experience using Microsoft Office applications, including Word, Excel, and Outlook.
  • Ability to communicate clearly and effectively in individual and group settings, both verbally and in writing.
  • Experience providing legal advice on various issues and matters.

 

Qualifications:

 

As a condition of pre-employment eligibility, a Level 2 security background screening is required, which consists of fingerprinting and a check of local, state, and national law enforcement records. 

 

.Minimum:

  • Juris Doctor from a law school accredited by the American Bar Association.
  • At least two (2) years’ experience practicing law.
  • Must be an active member of The Florida Bar in good standing and eligible to practice law.
